ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8. No person under the age of fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
a) he is the child of the holder of the premises licence;
b) he resides on the premises, but is not employed there;
c) he is in the bar solely for the purposes of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
d) he bar is in premises constructed, fitted and intended to be used bona fide for any purposes to which the holding of the licence is ancillary.
e) i. He is in an area shown on the plan attached to the licence
ii. Meals and non-alcoholic beverages are available for sale for consumption in that area.
iii. He is in the company of a person aged 18 or over.
iv. He is there prior to 9 p.m.
v. He may remain in the area of the premises specified during the first thirty minutes after this condition has ceased for him or the person whose company he is in to consume a meal purchased before the condition ceased to be operational.
In this condition “bar” includes any place exclusively or mainly used for the consumptions of intoxicating liquor. But an area is not bar when it is unusual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
Conditions Consistent with the Operating Schedule
1. If after the expiry of six months from the second appointed date the Licensing Authority serves written notice on the licensee requiring that CCTV be provided it will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority and the following conditions 2 - 4 also complied with.
2. Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with the Police and Local Authority.
3. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
4. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
5. In respect of a member of the public who are residing overnight at the premises in one of the hotel rooms shown in the plan of the first floor of the premises as a paying guest (the resident guest) and/or their bona fide private friend(s) (being entertained at the expense of the resident guest), it is proposed that the sale/supply of alcohol be from the bar on the ground floor of the premises for consumption either in the existing licensed area on the ground floor and beer garden of the premises or the bedroom of the resident guest.
6. All safety certificates and inspection reports will be kept on site and made available for inspection by officers or relevant statutory bodies.
7. The premises will be subject to regular fire certificate inspection both in respect of the ground floor and first floor.
8. There will be at all times adequate first aid arrangements. First Aid kits are situated in the kitchen and behind the bar. All staff have received suitable training as to what to do in an emergency and in general safety precautions.
9. Licensable activities will not be carried out within the beer garden on any day between 11.20 pm and 7.00 am the following morning
10. Waste from the premises (including glassware) will be disposed of using the correct disposal methods and containers and at times of the day when minimal disturbance would be caused.
11. Children attending at the premises are only permitted entry if accompanied and supervised by an adult and are only allowed to remain in those parts of the premises that they are permitted by law to be in whilst accompanied by such an adult.
12. A wide selection of non-alcoholic drinks is also available for purchase at the premises.
13. Staff at the premises are trained in respect of the legal obligations attaching to the sale and supply of alcohol to persons under 18.
14. The extent of the areas within which the various licensable activities will be permitted is as shown outlined in RED on the plan deposited with and approved by this Licensing Authority.
