ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The maximum occupancy figure for the whole premises will be 760 persons in agreement with the Licensing Authority and Devon Fire & Rescue Service and based on fire safety issues, available floor space and the sanitary accommodation available. This figure is not to be amended without consultation and agreement by those Authorities.
2. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and the Licensing Authority.
3. CCTV recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Licensing Authority)
4. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
5. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
6. All instances of crime and disorder will be recorded and reported to the proper authorities.
7. Suitable door staff registered with the Security Industry Authority to be employed from 9.00 pm until 30 minutes after the end of permitted hours on any day that live music or recorded music or any entertainment of a similar nature is planned to take place on the premises with the event being open to public and continuing after midnight.
8. On Sundays to Wednesdays there will be at least 1 member of doorstaff on duty. Should capacity limits exceed 100 then a minimum of 2 doorstaff will be required. On Thursdays, Fridays and Saturdays the ratio of 1:100 will apply. On Saturdays there will be a minimum of 5 doorstaff on duty at least one of which is to be female. In all other circumstances the level of doorstaffing required will be at the discretion of the Designated Premises Supervisor in accordance with the standard ratio of 1:100.
9. Where door staff are employed in connection with conditions 7 & 8 above they will:
a. be correctly registered with the SIA
b. display a correct name badge
c. carry proof of registration
d. wear clothing that can be easily and clearly identifiable on CCTV.
10. Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
11. A policy will be in force for the management of large groups, e.g. hen and stag parties. The group will be required to nominate a responsible person to liaise with staff.
12. No customers carrying open or sealed bottles or glasses will be admitted to the premises at any time.
13. Entry or the service of alcohol will be refused to anyone drunk or appearing to drunk or aggressive.
14. All bottles and glasses will be removed from public areas as soon as practicable when they are finished with.
15. There will be a 30 minute drinking up time prior to the premises closing when alcoholic beverages will not be supplied and house lights will be turned up and the music played at a reduced level.
16. The balcony and front area shall not be used and the doors accessing this area will be kept closed between the hours of 11.00 pm and 10.00 am.
17. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. A competent person will be a qualified electrician who is registered with the ECA or NICEIC.
18. Special effects such as strobe lighting, smoke, foam, lasers, pyrotechnics, dry ice or bubbles will not be used unless full safety controls are put in place and prior to consideration of guidance and/or following consultation with the Environmental Health Service.
19. All staff will have proper training in all emergency procedures.
20. All accesses, doors and common areas will be regularly checked by staff throughout the hours of trading.
21. An adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons.
22. The provision of plastic glasses and bottles will be reviewed depending on the type of entertainment provided, the number and behaviour of patrons.
23. An appropriate method for checking the number of people entering and leaving the premises will be employed and steps will be taken so that, once the maximum occupancy is reached, no further persons are admitted. The method employed is an electronic counting system.
24. All recommendations of the Fire Officer or other authority will be acted upon.
25. All recommendations of local authority officers concerning noise pollution, health and safety or other matters will be considered.
26. A noise limiting device will be installed and maintained to the satisfaction of East Devon District’s Council’s Corporate Director - Communities.
27. A policy of requesting patrons to leave the area quickly and quietly will be introduced.
28. Suitable signage will be displayed at the exit to request the co-operation of patrons, in particular to be as quiet as possible when leaving the premises.
29. An announcement will be made prior to closing requesting patrons’ co-operation in leaving the premises and vicinity as quietly and quickly as possible.
30. Patrons will be asked not to stand around talking in the street outside the premises and asked to leave the vicinity quickly and quietly.
31. When live bands or recorded music are playing, the exterior of the premises will be checked periodically by the management or senior member of staff to prevent noise nuisance.
32. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity / entertainment and periodically throughout thereafter.
33. All deliveries, as far as possible will be timed to ensure the least disturbance to nearby residents.
34. All staff will be trained in matters relating to children and will be made aware of the Proof of Age Policy set out in condition 35 below.
35. A published Proof of Age Policy produced by the Management of the Club and in agreement with the Devon & Cornwall Constabulary will be lodged with the Licensing Officer, Devon & Cornwall Constabulary, The Police Station Exmouth. This policy will be enforced after 9.00 pm.
36. No customers carrying open or sealed bottles or glasses, except for plastic bottles of water, must be allowed to leave the premises at any time.
37. The extent of the areas within which the various licensable activities will be permitted is as indicated by the legend on the plan submitted to and approved by the Licensing Authority.
