ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
CONDITIONS CONSISTENT WITH THE PREMISES OPERATING SCHEDULE.
1. Occupancy figures for the function room will be 130 seated or 150 dancing, or such other numbers as agreed with the Fire and Local Authority based on fire safety issues, available floor space and sanitary accommodation.
2. Door Supervisors will be employed at the premises at the discretion of the Designated Premises Supervisor following consultation with the Licensing Authority and the Police. If door supervisors are required they will be :-
a) Registered with the Security Industry Authority.
b) Will display a correct name badge.
c) Will carry proof of registration.
d) Will be used as a ratio to be agreed by the Police and Local Authority (current suggestion is 1:75).
e) There be no less than two Door Supervisors.
f) In attendance at such hours as agreed with the Police and Licensing Authority to ensure safe access and egress to the event
3. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and the Licensing Authority
4. CCTV recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Licensing Authority)
5. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
6. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
7. There will be a 30 minute wind down period following the cessation of the supply of alcohol on the premises, on the expiry of which the premises will close.
8. All staff will be appropriately trained in licensing issues.
9. No customers carrying open or sealed bottles of glasses will be admitted to the premises at any time.
10. No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
11. Regular glass and bottle collection will be undertaken throughout opening hours.
12. A proof of age policy to the satisfaction of the Police and the Local Authority will be in place, only photographic identification being acceptable.
13. The management of the Hotel will not tolerate the use, supply or possession of drugs on the premises and any person so found to have contravened this policy will be banned from the premises and the fact will be reported to the Police.
14. The fire safety measures with which the premises are provided will be maintained in good working order and their adequacy will be determined on a regular basis by the carrying out of a fire risk assessment as required by and in accordance with the Fire Precautions (Workplace) Regulations. The Management and Designated Premises Supervisor understand and appreciates that the safety of persons on the premises is influenced by the numbers of persons present, their disposition and the activities taking place and therefore undertake to maintain a safe occupancy level and to co-operate with the Fire Authority in this regard.
15. All exit doors will be easily operable without the use of a key, card, code or similar means and will be available for egress while the public are on the premises.
16. Means of escape will be maintained, unobstructed, immediately available and clearly identifiable
17. All gangways, exit ways, tread of steps or stairways will be maintained with non-slippery and even surfaces.
18. Notices detailing the action to be taken in the event of a fire or other emergency will be prominently displayed and maintained in good condition.
19. All lavatories, urinals and wash basins shall at all times be kept in good order and repair and be properly and effectually cleaned, ventilated and disinfected and supply with water and all necessary requisites and all doors leading thereto shall be suitably marked.
20. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. A competent person will be a qualified electrician who is registered with the ECA or NICEIC.
21. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
22. All safety certificates and inspection reports will be kept on site and made available for inspection by officers or relevant statutory bodies.
23. When disabled people are present adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
24. An adequate and appropriate supply of first aid equipment in the form of a first aid box/kit will be available for use of patrons.
25. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment
26. The designated premises supervisor, or such person so authorised by him, will control the volume of music or other apparatus used.
27. Patrons will be asked not to stand around talking in the street outside the premises or in the car park of the premises and asked to leave the vicinity as quietly and quickly as possible when leaving at all times but in particular during the hours of darkness.
28. The delivery, collection and storage of goods and refuse will be performed in a manner sympathetic to the locality of the premises.
29. No children will be allowed on the premises unless accompanied by an adult.
30. The lounge bar is designated as a no smoking area and notices will be in place informing patrons of this.
31. The licensable activities authorised by this licence will be confined to the areas that are outlined in RED on the plan accompanying the licence.
