ANNEXE 2 - Conditions Consistent with the Premises Operating Schedule
1. All bottled drinks will be served into glasses and the bottle retained in a designated ‘bottle bank’, before the drink is made available to the public.
2. Drinks will only be consumed within the licensed premises. No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
3. A proof of age policy, to the satisfaction of the police and the Local Authority, will be in place.
4. Irresponsible drinks promotions will not be permitted and the Standards for the Management of Standard Drinks Promotion produced by the British Beer and Pub Association will be complied with.
5. An anti drug policy, agreed by the Police and local authority, will be in force.
6. A secure facility to store controlled drugs will be available.
7. The manager or senior member of staff will make periodic inspections of the premises to ensure there are no risks to patrons and that all precautions for safety and the prevention of crime and disorder are in place.
8. All instances of public disorder will be recorded in an incident book.
9. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. (The installation to have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
10. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30 mA and should comply with BS 4293. The device will be tested monthly and tests will be recorded.
11. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
12. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
13. Free drinking water will be available at all times.
14. We will ensure that at all times there are adequate first aid arrangements. These arrangements for first aid provision include a qualified first aider to be available on site at all times and an adequate and appropriate supply of first aid equipment and materials will be available for use the by the first aider.
15. The maximum occupancy figures for the premises will be 200 persons or any future figure advised by the Devon Fire and Rescue Service and based on fire safety issues, available floor space and the sanitary accommodation available.
16. There will be employed an appropriate method for checking the number of people entering and leaving the premises and steps will be taken so that, once the maximum occupancy is reached, no further persons are admitted. The method employed must be to the satisfaction of the Devon Fire and Rescue Service and the Licensing Authority. The method employed when the licence was issued is the recording of the numbers of the public entering the premises in a daily log book (as they enter) and the hotel management will cause this number to be added to the number of overnight guests to provide a running total. Once the maximum occupancy figure of 200 has been reached, the hotel management will prevent any further persons entering the premises.
17. The sanitary accommodation consists of:
3 female WC’s and 2 WHBs on the ground floor.
2 male WCs, 3 urinals and 2 WHBs on the ground floor.
Every guest bedroom has its own WC and WHB
18. Gangways, exit routes and steps will be maintained in good order with non-slippery and even surfaces; edges of steps and stairways will be conspicuously marked.
19. All staff will receive suitable training as to what to do in an emergency and in general safety precautions.
20. Regular glass and bottle collections will be undertaken throughout opening hours.
21. A means of addressing patrons during operating hours, which can be heard above entertainment, or a means of interrupting the entertainment to make important safety announcements, will be available.
22. The Manager will control the sound levels of the music/entertainment and ensure that a level of 90decibels is not exceeded.
23. All external doors and windows will be kept shut, other than for access and egress, in all rooms when events involving amplified music or speech or other entertainment are likely to give rise to noise.
24. The emergency exits will be maintained well fitted and kept shut during opening hours.
25. Staff will check prior to entertainment, and periodically during the entertainment, that all windows and doors are shut.
26. The Manager will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
27. To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible 1 metre from the facade of the nearest residential property.
28. To prevent entertainment being intrusive, noise emanating from the premises will not exceed 5 dBA in any octave band for a 5 minute Leq above background level at the facade of the nearest residential property.
29. Between 11.00 pm and midnight, to prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above background levels and shall not cause a statutory nuisance.
30. Provision of mechanical ventilation and air conditioning systems will not allow noise breakout from the premises or cause a nuisance by its operation.
31. Regular maintenance will be carried out on all plant and machinery to ensure that noise disturbance from such sources does not occur.
32. The delivery of goods will be restricted to between the hours of 9.00 am and 5.00 pm.
33. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night or during the early morning, when the noise generated could cause a nuisance particularly outside the buildings.
34. Bottle skips and bins containing cans or bottles will not be emptied outside after 5.00 pm.
35. All the rubbish produced by the premises will be stored securely in a designated area or in a bin with a tight fitting and lockable lid.
36. The movement of bins and rubbish outside the premises will take place only between 9.00 am and 5.00 pm.
37. The live music authorised by this licence shall be provided by not more than two performers.
38. Alcohol shall only be sold or supplied to, and regulated entertainment provided within the licensed premises, for those persons:
a) Attending entertainments, dances, dinners and other functions held on the premises.
b) Attending entertainments, dances, dinners and other functions of a private nature held on the premises.
c) Attending trade, business and other artistic exhibitions held on the premises.
d) Employed whole or part time at the premises and bona fide guests of such employees.
e) Hotel guests staying at the premises and to persons taking bona fide meals at the premises.
