ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The maximum capacity for the premises will not be permitted to be exceeded.
2. The designated premises supervisor will ensure orderly conduct.
3. The premises are and will be adequately lit, ventilated and all fire precautions will be observed.
4. The premises are currently suitable for the purpose and that suitability will be maintained.
5. An incident book and recorded details of all incidents or public disorder will be kept and made available for inspection by officers of relevant statutory bodies.
6. Staff will be and are trained to be vigilant and will regularly supervise the premises both indoors and outside to check for orderly conduct.
7. A proof of age policy agreed by the police and local authority will be enforced.
8. The The fire safety measures with which the premises are provided must be maintained in good working order, and their adequacy will be determined on a regular basis, by the carrying out of a fire risk assessment as required by, and in accordance with the Regulatory Reform (Fire Safety) Order 2005. The Management and Designated Premises Supervisor understand and appreciates that the safety of persons on the premises is influenced by the numbers of persons present, their disposition and the activities taking place and therefore undertake to maintain a safe occupancy level and to co-operate with the Fire Authority in this regard.
9. All exit doors will be easily operable without the use of a key, card, code or similar means and will be available for egress while the public are on the premises.
10. Means of escape will be maintained, unobstructed, immediately available and clearly identifiable.
11. Exit doors will be regularly checked to ensure they function satisfactorily and will be available for egress while the public are on the premises.
12. Records of these checks will be kept and produced on request.
13. Any removable security fastenings will be removed whenever the premises are open to the public or staff.
14. All gangways, exit routes and steps will maintain non-slippery and even surfaces.
15. All floor coverings will be secured and maintained so that they will not ruck.
16. Hangings/curtains and temporary decorations will be maintained in flame-retardant condition.
17. Upholstered seating will be fire-retardant and will comply with current fire safety regulations.
18. Curtains, hangings and temporary decorations will not obstruct exits.
19. Fire safety signs of fire fighting equipment notices detailing any actions to be taken in the event of fire or other emergency will be properly displayed and maintained in good condition.
20. Access will be provided for emergency vehicles and this access will be kept clear and free from obstruction.
21. An evacuation policy will be in place and is to the satisfaction of the fire authority. All staff members will be trained in the evacuation policy.
22. Exit doors will be regularly checked to ensure they function satisfactorily and will be available for egress while the public are on the premises.
23. Fire alarms and fire fighting equipment will be serviced and tested annually by an approved contractor.
24. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. (The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
25. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker should operate at a current not exceeding 30 mA and should comply with BS 4293. The device will be tested monthly and tests will be recorded.
26. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
27. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
28. The gas system including appliances will be inspected and tested by a Gas Safe registered engineer annually and a satisfactory gas safety certificate will be obtained.
29. All safety certificates and inspection reports will be kept on site and made available for inspection by officers or relevant statutory bodies.
30. Cellar Gas System maintenance, its testing and staff training shall be in accordance with Pressure Vessel Regulations and shall include a carbon dioxide alarm fitted to the cellar.
31. When disabled people are present, adequate arrangements will exist to enable their safe evacuation in the event of an emergency. Review and assessment of accessibility in line with the Disability Discrimination Act is complete and kept on the premises.
32. The sanitary accommodation consists of 3 female WCs and 2 female WHBs, 4 male urinals HB, 2 male WCs and 3 male WHBs.
33. An adequate and appropriate supply of First Aid equipment and materials will be available on the premises for use by patrons.
34. Suitable protective equipment will be provided to deal with hypodermic needles, blood spillage and other body fluids.
35. Procedures will be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable disease.
36. Gangways, exit routes and steps will be maintained in good order with non-slippery and even surfaces, edges of steps and stairways will be conspicuously marked.
37. A means of addressing patrons during operating hours, which can be heard above entertainment, or a means of interrupting the entertainment to make important safety announcements will be available.
38. Noise or vibration will not emanate from the premises such as to cause persons in the neighbour-hood to be unreasonably disturbed.
39. All external doors and windows will be kept shut, other than for access and egress, in all rooms when events involving amplified music or speech or other entertainment likely to give rise to noise are taking place.
40. Sufficient ventilation will be provided so that doors and windows can be kept closed.
41. Suitable signage will be displayed at all relevant exits requesting that patrons make as little noise as possible when leaving the premises.
42. Patrons will be asked not to stand around talking in the street outside the premises or any car park, and asked to leave the vicinity as quietly and quickly as possible.
43. An announcement will be made prior to closing requesting patrons’ cooperation in leaving the premises and vicinity as quietly and quickly as possible.
44. The volume of amplified sound used in connection with the entertainment shall at all times be under the control of the designated premises supervisor or a member of the management team.
45. Provision of mechanical ventilation and air conditioning systems will not allow noise breakout from premises or cause a nuisance by its operation.
46. Where plant and machinery has the potential to cause a noise problem it will be positioned in such a way that the building structure provides as much screening as possible for nearby noise - sensitive properties. Alternatively, or additionally, control measures such as acoustic enclosures, acoustic louvers, silencers, or acoustic screening will be considered.
47. Regular maintenance will be carried out on a plant and machinery to ensure that noise disturbance from such sources is kept to a minimum.
48. Regard will be had to BS 4142 rating industrial noise affecting mixed residential and industrial areas and the institute of acoustic good practice guide on the control of noise from pubs and clubs.
49. The delivery of goods is restricted to the following times - between 8:00 am and 5:00 pm.
50. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
51. Bottle skips and bins containing cans or bottles will not be emptied outside after closing but will be dealt with the next day during normal office hours (save as for Sundays and New Year’s Day).
52. The movement of bins and rubbish outside the premises will be kept to a minimum/prohibited after 5.00pm.
53. All children on the premises shall be supervised at all times by a responsible adult over 18 years of age.
