ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964 - The Barn Hotel - Restaurant & Residential Licence
The embedded conditions numbered 1 to 6 below relate only to the area outlined in RED on the plan marked LIC/05/100/1 deposited with and approved by the Licensing Authority.
1. Alcohol shall not be sold or supplied:
(i) Unless the premises have been structurally and bona fide used, or intended to be used, for the purposes of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises; and unless the premises are bona fide used, or intended to be used, for the purposes of habitually providing for reward board and lodging, including breakfast and one other at least of the customary main meals;
(ii) On the premises otherwise than to persons taking table meals there and for consumption by such a person as an ancillary to their meal, or to persons residing there or there private friends bona fide entertained by them at their expense, and for consumption by such a person or their private friends so entertained by them either on the premises or with a meal supplied at but to be consumed off the premises.
2. The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises, where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
3. Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
4. There shall be afforded in the premises, for persons provided with a board and lodging for reward, adequate sitting accommodation in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or for the supply or consumption of intoxicating liquor.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
6. The licensable activities for the Barn Hotel authorised by this licence will be confined to the areas that are outlined in RED on the plan marked LIC/05/100/1 deposited with and approved by the Licensing Authority
Embedded Conditions Consistent with the Licensing Act 1964 - Barn Hotel Extension - On Licence with Conditions
The embedded conditions numbered 1 to 11 below relate only to the area outlined in RED on the plan marked LIC/05/100/02 deposited with and approved by the Licensing Authority.
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the permitted hours, the taking of alcohol supplied in the premises from the premises unless the alcohol is supplied or taken in an open vessel.
9. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the premises.
10. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
11. The licensable activities authorised for the Barn Hotel Extension by this licence will be confined to the areas that are outlined in RED on the plan marked LIC/05/100/02 deposited with and approved by the Licensing Authority.
Conditions Consistent with the Justices’ On Licence relating to the Barn Hotel Extension
1. The sale or supply of intoxicating liquor is authorised only to persons attending entertainments, dances, dinners, receptions, trade or business meetings or other functions held on the premises.
2. Intoxicating liquor shall not be sold or supplied for consumption off the premises.
