ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The licensable activities authorised by this licence to take place within the "entertainment complex" relate to the areas known as Capones, Bugsy's, Mash & Barrel and Sports Bar unless otherwise specified.
2. The licensable activities authorised by this licence to take place within the "external areas" will be confined to the areas outlined in RED on the plans numbered 4538-DE-130 and 4538-DE-131 submitted to and approved by the Licensing Authority.
STAFF TRAINING
3. AII staff will receive adequate training to ensure they are aware of all social and legal obligations of relevant legislation.
4. All staff engaged in licensable activity at the premises will receive training and information in relation to the following:
i. The Challenge 25 scheme in operation at the premises, including the forms of identification that are acceptable.
ii. The hours and activities permitted by the premises licence issued under the Licensing Act 2003 and conditions attached to the licence.
iii. How to complete and maintain the refusal register in operation at the premises (in relation to the sale of alcohol).
iv. Recognising the signs of drunkenness.
v. The operating procedures for refusing service to any person who is drunk, under-age or appears to be under-age, or appears to be making a proxy purchase.
vi. Action to be taken in the event of an emergency, including reporting an incident to the emergency services.
5. Training shall be recorded in documentary form and shall be regularly refreshed at no greater than 12 month intervals. Training records shall be made available for inspection and copying at reasonable times upon request of an authorised officer of a responsible authority.
6. Training records will be retained for at least 12 months.
PROOF OF AGE SCHEME
7. Any person who a member of staff believes to be under the age of 25 will be required to produce proof of age that they are over the age of 18 before being allowed to purchase or consume alcohol.
8. The premises licence Holder shall accept the following forms of identity/ valid proof of age and identity:
-Picture driving licence
-Passport,
-PASS accredited proof of age card and;
Any other form of identity as approved or prescribed by the secretaries of state as a mandatory condition.
REFUSALS REGISTER
9. An alcohol sales refusal register shall be kept at the premises and be maintained to include details of all alcohol sales refused. The register will include:
i. the date and time of refusal
ii. the reason for refusal
iii. details of the person refusing the sale
iv. description of the customer
v. any other relevant observations.
10. The refusals register will be made available for inspection and copying on request of an authorised officer of a responsible authority.
11. All entries must be made within 24 hours of the refusal.
ALL PREMISES PROVIDING LICENSABLE ACTIVITIES OTHER THAN THE OUTSIDE AREAS LICENSED TO SELL ALCOHOL:
CCTV
12. The premises shall install operate and maintain a comprehensive digital colour CCTV
13. All internal public areas of the licensed premises including entry and exit points will be covered.
14. The system must record clear images permitting the identification of individuals, and in particular enable facial recognition images (a clear head and shoulder image) of every person entering and leaving in any light condition.
15. The CCTV system will continually record whilst the premises are open for licensable activities and during all times when customers remain on the premises.
16. All equipment must have a constant and accurate time and date generation.
17. All recordings will be stored for a minimum period of 14 days with date and time stamping.
18. Viewable copies of recordings will be provided on request to the Police or local authority officers as soon as is reasonably practicable and in accordance with the Data Protection Act 2018 (or any replacement legislation) a staff member from the premises who is conversant with the operation of the CCTV system, shall be on the premises at all times when the premises are open. This staff member must be able to provide an authorised officer of a responsible authority, copies of recent CCTV images or data with absolute minimum of delay when requested in accordance with the Data Protection Act 2018 (or any replacement legislation).
19. The CCTV system will be capable of downloading images to a recognisable viewable format.
20. There will be security measures in place to ensure the integrity of the system to prevent the tampering with, and deletion of, images.
21. A person trained in first aid will be on the premises when licensable activities are being provided.
22. Toughened glassware will be used in any premises serving alcohol for consumption on the premises.
OUTSIDE AREAS LICENSED TO SELL ALCOHOL ONLY:
23. Polycarbonate or plastic glassware will be used at the mobile bars serving alcohol in outside areas.
MINI MARKET ONLY:
24. Alcohol should not be sold in an open container or be consumed within the Mini Market area.
ENTERTAINMENT COMPLEX COMPRISING OF CAPONE'S, BUGSY'S, MASH & BARREL AND SPORTS BAR ONLY:
25. Suitable door staff to be employed from 8:00 PM each day when public entertainment is taking place until 30 minutes after the end of permitted hours - this condition applies only to the entertainment complex comprising of Capone's, Bugsy's Mash & Barrel and Sports Bar.
26. The licensee shall ensure that where security personnel are employed in entertainment complex comprising of Capone's, Bugsy's, Mash & Barrel and Sports Bar, they enter in a register kept for that that purpose their full name security industry authority badge number (including expiry date), the time that they begin their duty and the time they completed their duty immediately after doing so. The register shall be kept on the premises at all times and should be made available for inspection by duly authorised officers of the licensing authority or a police officer. Registers shall be retained for at least 12 months from the last entry.
27. There must be no boxing on the entertainment complex comprising of Capones, Bugsy's, Mash & Barrel and Sports bar. Where a ring is used it must be constructed by a competent personnel should be inspected by a competent authority before using any material used formal skirt the rings shall be flame retardant members of the public must not occupy any seat which is closer than 2.5 metres to the ring.
28. A qualified medical first aider must be present throughout any sporting entertainment involving wrestling judo karate or sport of a similar nature within the entertainment complex comprising of Capone's, Bugsy's, Mash & Barrel and the Sports Bar.
29. The volume of any noise equipment used at the entertainment complex comprising of Capone's, Bugsy’s, Mash & Barrel and Sports Bar shall be under the control of the management from part of the premises which is not accessible to the public.
30. When volume limited devices are required at Capone's, Bugsy's, Mash & Barrel and Sports Bar to control the amplification of sound they should be effectively operated and maintained to ensure that the volume does not exceed the permitted sound level.
INCIDENT LOG
31. An incident log shall be kept and maintained for the Entertainment Complex (comprising of Capone’s, Bugsy’s, Mash and Barrel and the Sports Bar), which will include a log of the following, including pertinent details:-
i. Any incidents of disorder or of a violent or anti-social nature
ii. All crimes reported to the venue, or by the venue to the police
iii. All ejections of patrons
iv. Any complaints received
v. Seizures of drugs or offensive weapons
vi. Any faults in the CCTV system
vii. Any visits by a responsible authority (under the Licensing Act 2003) or emergency service.
32. Records must be completed within 24 hours of any incident, and will contain the time and date, the nature of the incident, the people involved, the action taken and details of the person responsible for the management of the premises at the time of the incident.
33. The logs shall be kept for at least 12 months following the date of entry and be made available for inspection and copying upon request of an authorised officer of a responsible authority.
BEACH SHACK ONLY:
34. The licence Holder and/or DPS shall carry out a risk assessment in relation to the use of The beach shack taking the operation and layout of the premises and the proposed activity to be carried out into consideration determine whether door stewards are required and employed SIA stewards in such numbers and at such times as determined by the risk assessment for the Beach Shack.
35. There will be no sale of off sales of alcohol at the Beach Shack only after 1800 hours.
36. The Beach Shack Only - Signs will be placed throughout the Beach Shack warning patrons of the dangers of entering the sea after consumption alcohol.
37. Staff at the Beach Shack will carry out litter duty at the Beach Shack every 30 minutes throughout the hours the premises are open to the public.
INCIDENT LOG
38. An incident log shall be kept and maintained for the Beach Shack, which will include a log of the following, including pertinent details:-
i. Any incidents of disorder or of a violent or anti-social nature
ii. All crimes reported to the venue, or by the venue to the police
