ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1 The proprietor will ensure that the public using the premises at all times have access to a telephone to call a taxi and will be provided with details of telephone numbers to call a taxi.
2 The proprietor will ensure that patrons are asked not to stand around talking in the street outside the premises and are directed to the nearest available ‘Taxi Rank’ and/or asked to leave the vicinity quickly and quietly.
3 The proprietor will have regular contact with the Devon and Cornwall Constabulary.
4 The proprietor will ensure that all staff receive suitable training as to what to do in an emergency and in general safety precautions and normal operating procedures.
5 The proprietor will ensure that all persons employed as door supervisors at the premises are correctly registered with the Security Industry Authority.
6 The proprietor will ensure that CCTV is installed maintained and operated to the satisfaction of the Chief Officer of Police and the Licensing Authority.
7 The proprietor will ensure that a personal licence holder is on the premises during those times when licensable activities are taking place.
9. Involvement in the Devon & Cornwall Constabulary Think Safe Drink Safe Campaign shall be maintained.
10. Membership of the local Licensees Committee shall be maintained.
11. Participation in the Devon & Cornwall Constabulary Radio Link scheme to be maintained.
12 All door supervisors employed at the premises will wear a current identification badge in a conspicuous position in front of the upper body at all times.
13. No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
14. Late night refreshment shall be available for consumption on the premises only.
15. Door supervisors shall conduct periodic security checks, to include search procedures, of both the premises and patrons.
16. A minimum of two correctly registered door supervisors to be employed at the premises from 9.00pm on Thursday, Friday, Saturday and any Bank Holiday evenings until the end of the premises opening hours. In addition the police ratio of 1 door staff to 75 persons shall be complied with.
17. Correctly registered door supervisors to be employed at the premises during those times that regulated entertainment in the form of recorded or live music is taking place at the premises until the end of the premises opening hours.
18. Correctly registered door supervisors to be employed at the premises during those times that any England international football game is being shown at the premises.
19. The maximum occupancy of the property shall not exceed 200 persons at any one time and there shall be no more than 67 persons at any one time within the prescribed area for dancing as shown on the plan referenced 04 1254 03 B dated February 2005.
20. Where possible the number of glass bottles being served over the bar will be limited.
21. Regular glass and bottle collection will be undertaken throughout opening hours.
22. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. (A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
23. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained
24. An adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons.
25. The proprietor or senior member of staff will check the premises prior to opening and then periodically during the hours that the premises are open to the public, to ensure there are no risks to patrons and that all safety precautions are in place.
26. There shall be seating available for up to 60% (120 persons) of the maximum occupancy figure for the premises at all times.
27. A noise limiting device will be installed, fitted and maintained in such a manner as to control all sources of amplified music and voices from the premises and the limit to be agreed with the District Council’s Corporate Director - Communities.
28. The volume of amplified music and voices to be reduced after 1.00am.
29. There will be a 30 minute wind down period following the cessation of the supply of alcohol on the premises, on the expiry of which the premises will close.
30. Suitable signage will be prominently displayed at the exits to request the co-operation of patrons, in particular to make as little noise as possible when leaving the premises.
31. Ventilation equipment will be regularly cleaned and maintained to control levels of odour generated by the premises.
32. Regular glass and bottle collection will be undertaken throughout opening hours.
33. All ground floor windows shall have blinds fitted and maintained and those blinds to be drawn at dusk each day.
34. Children under the age of 16 years will not be permitted to remain on the premises after 9.00 pm on any day.
35. All children on the premises shall be supervised at all times by a responsible adult over 18 years of age.
36. A proof of age policy agreed by the police and local authority will be enforced.
37. Notices will be displayed in the vicinity of any Amusement with Prizes machines installed in the premises prohibiting use by persons under the age of 18 years.
38. The licensable activities authorised by this licence will be confined to the areas that are shaded in PINK on the plan accompanying the licence.
