ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the permitted hours, the taking of alcohol supplied in the premises from the premises unless the alcohol is supplied or taken in an open vessel.
9. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the premises.
10. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption ancillary to the meals.
11. The sale by retail/supply of alcohol will be confined to the area(s) outlined in RED on the plan(s) deposited and approved by the Licensing Authority.
Additional Conditions Consistent with the Operating Schedule
1. All inclusive nights or other irresponsible drink promotions will not be permitted.
2. Irresponsible drinks promotions must not be permitted, and the Standards for the Management of Responsible Drinks promotions including Happy Hours produced by the British Beer and Pub Association will be complied with.
3. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and the Licensing Authority
4. CCTV recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Licensing Authority)
5. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
6. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
7. No customer carrying open or sealed bottles or glasses will be admitted to the premises at any time.
8. No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
9. All bottles and glasses will be removed from public areas as soon as they are finished with or empty.
10. All exit doors will be easily opened without use of a key, card, code or similar means and will be available for egress while the public are on the premises.
11. Means of escape will be maintained, unobstructed, immediately available and clearly identifiable.
12. Exit doors will be regularly checked to ensure they function satisfactorily. Records of these checks will be kept and produced on request.
13. Hangings, curtains and temporary decoration will be maintained in a flame retardant condition.
14. Upholstered seating will be fire retardant and compliant with current Fire Safety Regulations.
15. Curtains, hangings and temporary decorations will not obstruct exits, fire safety signs or fire fighting equipment.
16. Notices detailing the actions to be taken in the event of fire or other emergency will be prominently displayed and maintained in good condition.
17. Access will be provided for emergency vehicles and this access will be kept clear and free from obstruction.
18. Fire drill and emergency lighting tests will be conducted monthly. Records of these tests will be made available to the Licensing Authority upon request.
19. All fire exits and means of escape will be signed in accordance with BS5499.
20. The fire safety measures with which the premises are provided must be maintained in good working order, and their adequacy must be determined on a regular basis, by the carrying out of a fire risk assessment as required by, and in accordance with the Regulatory Reform (Fire Safety) Order 2005. The applicant understands that the fire safety of occupants is also influenced by numbers of persons present, their disposition and the activities taking place, and therefore undertakes to maintain a safe occupancy limit
21. Wall and ceiling finishes will be fire resistant.
22. Exit doors will open outwards (or will be secured in the open position).
23. When disabled people are present adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
24. Disabled people on the premises will be made aware of these arrangements.
25. Adequate and appropriate supply of first aid equipment and materials will be available on the premises.
26. Fire safety signs will be adequately illuminated.
27. Emergency lighting will not be altered.
28. Emergency lighting batteries will be fully charged before the admission of the public.
29. In the event of failure of normal lighting, where the emergency lighting battery has a capacity of one hour, evacuation of the premises will be possible within 20 minutes.
30. Emergency lighting tests will be conducted monthly.
31. Records of these tests will be made available to the Licensing Authority upon request.
32. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. A competent person will be a qualified electrician who is registered with the ECA or NICEIC.
33. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
34. Any oil fired boiler or appliance on the premises will be inspected and tested annually by a suitably qualified and competent person who will provide an annual certificate. A competent person will be one who is qualified to provide an OFTEC certificate.
35. Any suspended ceiling on the premises will be examined by a suitably qualified person every five years who will issue a certificate of safety.
36. All portable fire fighting equipment will be inspected annually and a certificate provided.
37. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of the relevant statutory bodies.
38. There must be in force public liability insurance for the minimum sum of £2million. A new certificate for public liability insurance must be issued each year.
39. Any certificate of public insurance will be made available for inspection by officers or relevant statutory bodies.
40. All external doors and windows will be kept shut, other than for access and aggress, in all rooms when events involving amplified music or speech or other entertainment are likely to give rise to noise.
41. Sufficient ventilation will be provided to ensure doors and windows can be kept closed during the live performances.
42. Children not allowed to approach the bar unless as a thoroughfare to other facilities.
43. Children will not be permitted on the premises after 9:00 pm.
44. A proof of age policy agreed by the police and local authority will be enforced.
45. Notices will be displayed in the vicinity of any Amusement with Prizes machines installed in the premises prohibiting use by persons under the age of 18 years.
