ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. When holding licensable events, regard will be had, as appropriate, to the principles set out in:-
(a) 5 Steps to Risk Assessment: Case Studies ISBN 07176 15804.
(b) Guide to Fire Precautions in Existing Places of Entertainment and Like Premises (The ‘Yellow Guide’) ISBN 011 340907 9.

And where the Licence Holder considers it necessary or appropriate to the circumstances and situation, the measures indicated in these guides will be undertaken.
2. The Licence Holder will ensure that staff are aware of social and legal obligations and responsibilities regarding the ways that the licensing objectives are protected at the premises.
3. The licence Holder will have regular contact with the Police and will implement all measures that are agreed in writing between the National Trust and the police.
4. Before any event takes place at the premises a risk assessment will be completed and measures taken to reduce any significant risks. All such risk assessments will be made available for inspection by officers of the Licensing Authority or other Responsible Authorities prior to, during or immediately after any event.
5. In relation to any licensed activity:-
(a) Copies of risk assessments will be requested from any sub-contractors.
(b) Electrical systems will be designed and maintained in accordance with the Electricity at Work Regulations 1989 and regard will be had to the current codes of practice on electrical installations.
(c) Should any event be planned to exceed a capacity of 1,000 persons at any one time, a safety co-ordinator will be nominated to assist in the monitoring of safety.
(d) Adequate lighting will be maintained at all times to a level that will facilitate emergency egress from any licensed area.
(e) An evacuation plan will be developed and maintained, which will be advised to all relevant members of staff.
(f) Adequate access will be maintained for emergency vehicles on property under the Licence Holder’s ownership and control whilst the premises are open to the public.
(g) The fire safety measures with which the premises are provided will be maintained in good working order and their adequacy is determined on a regular basis by the carrying out of a fire risk assessment as required by and in accordance with the Regulatory Reform (Fire Safety) Order 2005. The applicant understands that the fire safety of occupants is also influenced by numbers of persons present, their disposition and the activities taking place, and therefore undertakes to maintain a safe occupancy limit
(h) Structural surveys will be conducted of any parts of the building to which the public have access in accordance with the recommendations of the Licence Holder’s Buildings Team.
(i) Any defects identified within such a survey that might have a significant impact on public safety will be put right or the public will be excluded from the area that poses the risk.
(j) Before any specific event involving more than 1,000 people at any one time and where any structures are erected for the purpose housing a licensable activity, a plan will be prepared showing the location and nature of the structures, the public area and any restricted areas intended for performers.
(o) This plan to be submitted at least 1 month in advance to the Licensing Authority, Devon Fire and Rescue Service and the Devon and Cornwall Constabulary, unless a similar plan has already been provided and agreed by these authorities.
(p) Any temporary structure such as a marquee which is used for a licensable activity will comply with such reasonable advice and guidance as is agreed in writing from time to time with the Fire Authority.
(s) First aid provision will be made in accordance with statutory requirements.
(t) When holding licensable events, a sufficient number of staff must be engaged to assist in safe access and egress from the property. The number of staff required will be determined on a case by case basis in accordance with a risk assessment and the guidance set out in condition 1 of this Annexe, depending on the nature and size of the event.
(u) Sufficient quantities of water will be supplied, free of charge whilst any regulated entertainment is provided.
6. The Licence Holder will assess the impact of any noisy activities on neighbouring residential premises and implement such measures as they consider necessary or are agreed in writing with the Council’s Environmental Health Officer.
7. Where children are present at events, adult supervision will be requested of the accompanying adult or maintained by staff at all times.
8. Members of staff who are supervising children will be advised as to fire precautions and the evacuation plan.
9. If the Licence Holder believes that there is an activity which poses a special and unacceptable risk to children, no admittance will be permitted for children to the area of that risk unless the risk can be reduced to a level that is reasonable.
10. A proof of age policy agreed by the police and local authority will be enforced.
11. Any additional measures that are agreed in writing between the Authority responsible for advising on Child Protection and the Licence Holder will be implemented.
12. The licensable activities authorised by this licence will be confined to the areas that are marked on the legend and within the area outlined in RED on the plan deposited with and approved by the Licensing Authority.
