ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. All outside furniture must be removed and securely stored by 10:00pm each day.
2. CCTV must be installed, operated and maintained to the satisfaction of the Licensing Authority and the Chief Officer of Police in accordance with the requirements set out in the EDDC Licensing Policy.
3. CCTV images must be retained for a minimum of 14 days and to be produced on the request of the Police or a Licensing Officer of East Devon District Council. Recording media must be set to 25 frames per second.
4. The CCTV system must be operational at all times the premises are trading. If the system is faulty or not working then the Police and East Devon District Licensing Service must be informed immediately. Details of the malfunction must be recorded in the premises incident book.
5. A4 sized warning notices must be displayed in public areas of the premises and at all entrances advising that CCTV is in operation. The signs located at entrances should be located on the exterior of the building at, and adjacent to, all public access doors. All signs must comply with the requirements of the Data Protection Act 2002.
6. The licence holder must ensure that the store is adequately staffed so as to allow the proper management of the premises and supervision of those who visit them.
7. The licence holder must be mindful of their obligations to their staff, customers and others (e.g. local residents) that may be affected by the operation of the business.
8. The Subway system does not allow for the sale of alcohol.
9. No alcohol must be allowed on the premises.
10. All drinks and food must be served in plastic, cardboard or paper.
11. The licence holder must actively co-operate with the local police to ensure that they are aware of particular problems which affect the area and which may potentially affect the store.
12. The licence holder must conduct a risk assessment and if deemed necessary a town radio link will be purchased.
13. The premises must comply with all requisite health and safety legislation. A regular health and safety risk assessment must be carried out as required to do so under the terms of the franchise agreement.
14. All exits must be kept clear of obstruction and will be clearly identifiable.
15. All areas must have fully operational lighting, backed up by emergency lighting.
16. All windows and doors must be kept closed at night to prevent transmission of noise.
17. A suitable number of waste receptacles for refuse storage must be provided.
18. Suitable signage must be displayed requesting that people leave the premises and area quietly.
19. The licence holder must consider banning people who visit the store regularly and leave in a noisy fashion.
