ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Conditions offered by the applicant:
1 Events management will be undertaken by Exmouth Town Council. The Licensee, East Devon District Council, will be made aware of all events to be held on the site both as landowner and as the Licensing Authority. In addition, there will be liaison with the Police where it is reasonably anticipated that more than 500 people may attend an event. This could be judged on similarity between events held in previous years. It is obviously incredibly difficult to regulate numbers as the Strand is an open and public place.
2. Where an event takes place which the events management reasonably believe that that there will be more than 500 people, the must carry out a risk assessment.
3. Where any part of the Strand area is to be hired out, there must be an agreement between the Licence Holder and any hirer of the premises. A copy of the Premises Licence will be made available to the hirer to ensure that they will comply with the conditions.
4. Before any event is due to take place for which the events management reasonably believe that there will be more than 500 people in attendance, they must lodge an Event Management Plan with the Licensing Authority, Police and Environmental Health department which must be to their satisfaction. Permission to hold the event will not be unreasonably withheld providing that the promoter shows due diligence.
5. CCTV is currently installed, operated and maintained in the Strand.
6. CCTV images will be retained for a minimum period of 14 days and to be produced on the request of the Police or a Licensing Officer of East Devon District Council.
7. The licence holder or hirer must check the premises prior to any events in order to ensure that all reasonable steps have been taken to minimise risks to patrons and that all applicable safety precautions are in place.
8. The licence holder or hirer must ensure that all staff receive appropriate training regarding emergency and general safety precautions and procedures.
9. All litter must be removed from the area on a regular and frequent basis and any drinks or beverages will be served in plastic, cardboard or polystyrene vessels.
10. The licence holder or hirer must ensure that staff regularly patrol the premises to supervise the orderly conduct of the patrons.
11. The licence holder or hirer must reasonably control the volume of the regulated entertainment taking place at the premises.
12. All litter must be removed from the area on a regular and frequent basis and any drinks or beverages will be served in plastic, cardboard or polystyrene vessels.
