ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The principal use of the premises shall be and must remain that of a cafe'/restaurant. The additional licensing activities of regulated entertainment shall be ancillary to the use of the premises as a cafe'/restaurant.
2. CCTV must be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Licensing Authority.
3. Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Licensing Authority).
4. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
5. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
6. Door supervisors must operate on the premises on Fridays and Saturdays and will be in attendance at the entrance of the premises from 9:00 pm until the main exit doors to the premises are closed.
7. Door supervisors must be used at a ratio to be agreed by the Police and the Licensing Authority, which is currently 1:75.
8. Door supervisors must be correctly registered with the SIA and will display the correct name badge and carry proof of registration.
9. Alcoholic drinks must only be consumed in the cafe seating areas and the external seating enclosure.
10. Any alcohol served for consumption in the outdoor seating area will be served in plastic containers.
11. The use of the outside seating area must cease by 9:00 pm and all tables and chairs must be removed and stored inside the premises.
12. All bottles and glasses must be removed from the public areas as soon as they are finished with or empty.
13. Consideration must be given to setting capacity limits to prevent overcrowding which could lead to crime and disorder. The capacity figure will be based on advice from the Police, Fire or Licensing Authority.
14. A proof of age policy, to the satisfaction of the Police and the Licensing Authority must be enforced.
15. Irresponsible drinks promotions must not be permitted, and the Standards for the Management of Standard Drinks Promotions Including Happy Hours produced by the British Beer and Pub Association will be complied with.
16. An incident book must be kept to record details of all instances of public disorder.
17. The electrical system at the premises, including portable appliances must be inspected and tested annually by a competent person to ensure safety. (The installation must have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
18. Where temporary electrical equipment is used, a suitable circuit breaker device must be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and must comply with BS 4293. The device will be tested monthly and the tests will be recorded in a log kept for the purpose.
19. Temporary electrical wiring and distribution systems must not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
20. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, must be inspected and certified by a qualified electrician before they are put to use.
21. The gas system including appliances must be inspected and tested by a Corgi registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
22. All safety certificates and inspection reports must be kept on site and made available for inspection by officers of relevant statutory bodies.
23. When disabled people are present, adequate arrangements must exist to enable their safe evacuation in the event of an emergency.
24. The sanitary accommodation will consist of:
· 1 Male WC's + 1 urinal on the first floor (With 2 WHBS),
· 2 female WCs on First floor (2WHBS) 1 Female WC ground floor (1 WHBS).
25. The delivery of goods must be restricted to the normal working day.
26. Bottle skips and bins containing cans or bottles must not be emptied outside after 10:00pm, but will be dealt with the next day during normal office hours.
27. Where partition walls are adjacent to accommodation areas of the surrounding properties sound proofing will be provided in accordance with the current Part E. Building Regulations.
28. Suitable signage must be prominently displayed at the exit to request the co-operation, of patrons in particular, to make as little noise as possible when leaving the premises.
29. Alcohol must be kept in a lockable cabinet/refrigerator.
30. All staff must receive suitable training as to what to do in an emergency and in general safety precautions.
31. The licence holder must ensure that staff regularly patrol the premises both indoors and out to supervise the orderly conduct of patrons when regulated entertainment is being provided.
32. The licence holder, or persons authorised by them, must control the volume of regulated entertainment taking place at the premises.
33. On any day when regulated entertainment has been provided at the premises an announcement must be made prior to closing requesting patrons’ co-operation in leaving the premises and vicinity as quietly and quickly as possible.
34. A noise limiting device must be installed and maintained on the first floor of the premises to control the volume of music. The limiter level must be set by an Environmental Health Officer for Pollution from East Devon District Council.
35. The licensable activities authorised by this licence will be as shown on the legend on the plan deposited with and approved by the Licensing Authority. The sale of alcohol will be restricted to the area shaded in PINK and the area marked BAR on the plan.
