• ANNEXE 1 - MANDATORY CONDITIONS

   

  1.              a)  There shall be no sale or supply of alcohol when there is no designated premises supervisor in respect of this premises licence or at a time when the said premises supervisor does not hold a personal licence or when his/her licence is suspended.

  b)  Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

• ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1.              The vessel will be inspected and certificated by the MCA (Maritime Coastguard Agency).

  2.              All crew will have received MCA approved training.

  3.              All boat masters will hold current licenses and operate their vessels within MCA regulations.

  4.              A personal License holder will supervise the sale of alcohol on the vessel.

  5.              All crew will be fully trained to MCA specifications.  They will supervise the embarking and disembarking of passengers.

  6.              There will be a security camera on the lower deck that allows the skipper to view passengers and the bar.

  7.              Passengers will not be allowed to take glasses of drink off the boat.

  8.              Passengers will not be allowed to bring their own alcohol (open or closed) on board without prior permission of the Designated Premises Supervisor and agreed corkages.

  9.              No passenger will be allowed on board if it is suspected they are under the influence of alcohol.

  10.              No passenger will be sold alcohol if it is suspected they are over intoxicated.

  11              The vessel will have a VHF radio on board to allow contact with the Coastguard and similar authorities and our own shore office.  All boat crew will be trained in how to use radios.

  12.              The vessel will not be allowed to carry more than the capacity stipulated by the Maritime Coastguard Agency.

  13.              A full safety announcement will be given to passengers as the boat departs.  This will include notifying the passengers that behaviour that endangers crew, other passengers or the vessels in any way will result in the termination of the cruise and the boats return to the nearest safe haven.

  14.              An accident book will be kept on board. All details of any injury or accident will be recorded in this.

  15.              No licensable activity will take place whilst the vessel is moored except in the 30 minutes before departing on a prearranged cruise.

  16.              The vessel will be subject to MCA regulations and a certificate issued by them after inspection will be obtained.

  17.              The vessel will carry and display a copy of MCA certificate and also the Public Liability insurance certificate.

  18.              The number of passengers and crew on board will be counted and recorded both on board and to the shore office.  If the shore office is unable to take these numbers the information will be passed to Brixham Coastguard.

  19.              Guests in wheelchairs must be accompanied by an attendant in case of an emergency.  The number of wheelchairs carried will be at the discretion of the boat master.

   

   

  20.              All crew on board will have basic first aid skills.  There will be a minimum of one member of crew on board who is a qualified in first aid.  First aid equipment will be kept on board in the bar area and will be checked regularly.

  21.              Suitable equipment will be kept on board to deal with spillages and also body fluids such as vomit.

  22.              Crew will be present as passengers disembark to discourage loud noises or nuisance activities in the area.

  23.              All passengers will be informed in the safety announcement of the time the boat will dock to allow them to arrange for transport away from the area.

  24.              Bottles, cans and other recyclable items will be taken to local depots.

  25.              Lighting on the vessel will be in line with MCA regulations.

  26.              Alcohol will not be sold to minors.

  27.              Children on board will not be exposed to nudity, striptease or films with adult content.

  28.              Children will be accompanied by a responsible adult aboard the vessel.

  29.              The extent of the areas within which the various licensable activities will be permitted are shown outlined in blue on the plan deposited with and approved by the Licensing Authority.

• ANNEXE 3 - CONDITIONS ATTACHED FOLLOWING A HEARING BY THE LICENSING AUTHORITY

   

  1.              There will be no ‘off’’ sales of alcohol permitted.

  2.              Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.

  3.              The Master will assess the impact of noisy activities on neighbouring residential premises to the vessel’s geographical position and take appropriate action to prevent public nuisance.

  4.              All the rubbish produced by the vessel will be stored securely in a designated area or bin with a tight fitting and lockable lid.  It will not be removed from the vessel between 22.00 hours and 08.00 hours.  When the rubbish is removed from the boat it will be into sealed bins and not left on the quayside

  5.              An anti drug policy, agreed by the Police and local authority, will be in force.

  6.              A Policy for the management of large groups will be in force requiring a group to nominate a responsible person to liase with staff on board.

  7.              Free fresh drinking water will be available on board at all times when the public have access to the vessel.  Non-alcoholic drinks shall be available for purchase at all times.

  8.              Gangways, exit routes and steps will be maintained in good order with non-slip and even surfaces.  Edges of steps and stairways will be conspicuously marked.

  9.              The provision of plastic glasses and bottles will be reviewed depending on the type of entertainment provided and the number and behaviour of patrons attending.

  10.              Regular glass and bottle collection will be undertaken throughout opening hours.

  11.              Handling of beer kegs, bottles and other similar items will not take place whilst the vessel is moored at Exmouth Marina between 22.00 hours and 08.00 hours, when the noise generated could cause a nuisance.

  12.              Bottle skips and bins containing cans or bottles will not be removed from the vessel whilst moored at Exmouth Marina between 22.00 hours and 08.00 hours the next day.
