ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
Conditions Consistent with the Premises Operating Schedule
1. The fire safety measures with which the premises are provided must be maintained in good working order, and their adequacy will be determined on a regular basis, by the carrying out of a fire risk assessment as required by, and in accordance with the Regulatory Reform (Fire Safety) Order 2005. The applicant understands that the fire safety of occupants is also influenced by numbers of persons present, their disposition and the activities taking place, and therefore undertakes to maintain a safe occupancy limit.
2. All staff will be trained in licensing matters and emergency procedures.
3. The hours for which the premises will be open will be clearly displayed with confirmation of times for the supply of alcohol and late night refreshment.
4. The premises are and will be adequately lit, ventilated and all fire precautions will be observed.
5. An incident book and recorded details of all incidents or public disorder will be kept and made available for inspection by officers of relevant statutory bodies.
6. Staff will be vigilant and regularly supervise the premises indoor and out to check orderly conduct.
7. A proof of age policy agreed by the police and local authority will be enforced.
8. All exit doors will be easily openable without the use of a key, card, code or similar means and will be available for egress while the public are on the premises.
9. All means of escape will be maintained, unobstructed, immediately available and identifiable.
10. Exit doors will be regularly checked to ensure they function satisfactorily and will be available for egress while the public are on the premises.
11. Records of these checks will be kept and produced on request.
12. Any removable security fastenings will be removed whenever the premises are open to the public or staff.
13. All gangways, exit routes and steps will maintain non-slippery and even surfaces.
14. All floor coverings will be secured and maintained so that they will not ruck.
15. Hangings/curtains and temporary decorations will be maintained in flame-retardant condition.
16. Upholstered seating will be fire-retardant and will comply with current fire safety regulations.
17. Curtains, hangings and temporary decorations will not obstruct exits.
18. Fire safety signs of fire fighting equipment notices detailing any actions to be taken in the event of fire or other emergency will be properly displayed and maintained in good condition.
19. Access will be provided for emergency vehicles and this access will be kept clear and free from obstruction.
20. An evacuation policy will be in place and is to the satisfaction of the fire authority. All staff members will be trained in the evacuation policy.
21. Exit doors will open outward (or will be secured in the open position).
22. Fire alarms and fire fighting equipment will be serviced and tested annually by an approved contractor.
23. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety. (The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
24. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment.
25. The circuit breaker should operate at a current not exceeding 30 MA and should comply with BS 4293.
26. The device will be tested monthly and tests will be recorded.
27. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitable qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or where applicable BS7909.
28. The gas system including appliances will be inspected and tested by Corgi Registered Gas Engineer annually and a satisfactory gas safety certificate will be obtained.
29. All safety certificates and inspection reports will be kept on site and made available for inspection by officers or relevant statutory bodies.
30. Free drinking water will be available at all times.
31. When disabled people are present, adequate arrangements will exist to enable their safe evacuation in the event of an emergency. Review and assessment of accessibility in line with the Disability Discrimination Act is complete and kept on the premises.
32. The sanitary accommodation consists of 1 male WC, 1 male wash H/B, 2 urinals, 2 female WC’s, 2 female wash H/B’s.
33. The management will ensure that at all times there are adequate first aid arrangements.
34. The management’s arrangements for first aid provision will include a first aid box, an adequate and appropriate supply of first aid equipment and materials to be used by patrons. Suitable protective equipment will be provided to deal with hypodermic needles, blood spillages and other body fluids. Procedures will be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable diseases.
35. Gangways, exit routes and steps will be maintained in good order with non-slippery surfaces, edges of steps and stairwells will be conspicuously marked.
36. Means of addressing patrons during operating hours, which can be heard above entertainment, or as a means of interrupting the entertainment and making important safety announcements will be available.
37. Noise or vibration will not emanate from the premises such as to cause persons in the neighbourhood to be unreasonably disturbed.
38. The volume of amplified sound used in connection with the entertainment shall at all times be under control of the management.
39. All external doors and windows will be kept shut where possible, other than for access and egress, in all rooms when events involving amplified music or speech or other entertainment likely to give rise to noise are taking place.
40. Sufficient ventilation will be provided so as to ensure that doors and windows can be kept closed, where possible.
41. Patrons will be asked not to stand around talking in the street outside the premises or any car park; and asked to leave the vicinity quickly and quietly.
42. Suitable signage will be displayed at the exit to request the co-operation, of patrons in particular, to make as little noise as possible when leaving the premises.
43. Suitable signage will be displayed in the garden areas requesting patrons to respect the amenities local residents.
44. An announcement will be made prior to closing requesting patrons’ co-operation in leaving the premises and vicinity as quietly and quickly as possible.
45. Provision of mechanical ventilation and air conditioning systems will not allow noise breakout from premises or cause a nuisance by its operation.
46. Where plant and machinery has the potential to cause a noise problem it will be positioned in such a way that the building structure provides as much screening as possible for nearby noise - sensitive properties. Alternatively, or additionally, control measures such as acoustic enclosures, acoustic louvers, silencers, or acoustic screening will be considered.
47. Regular maintenance will be carried out on a plant and machinery to ensure that noise disturbance from such sources is kept to a minimum.
48. Regard will be had to BS 4142 rating industrial noise affecting mixed residential and industrial areas and the institute of acoustic good practice guide on the control of noise from pubs and clubs.
49. The delivery of goods is restricted to the following times - between 8:00 am and 5:00 pm.
50. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night and during the early morning, when the noise generated could cause a nuisance particularly outside buildings.
51. Bottle skips and bins containing cans or bottles will not be emptied outside after closing but will be dealt with the next day during normal office hours (save as for Sundays and New Year’s Day).
52. The movement of bins and rubbish outside the premises will be kept to a minimum/prohibited after 5:00 pm.
Additional Conditions
A minimum of 2 SIA licensed door supervisors shall be on duty at the premises from 21:00 on any day the premises is permitted to sell alcohol beyond midnight and intends to trade beyond midnight.
On any day the premises are permitted to sell alcohol beyond midnight, their intention to cease trading at midnight or earlier must be recorded in a diary prior to 21:00 and be available for inspection by the Police or Local Authority at any reasonable time.
On any day the premises are permitted to sell alcohol beyond midnight, their intention to cease trading at midnight or earlier must be clearly advertised prior to 21:00 in the premises for customers to see.
On any day the premises are not required to employ door supervisors the DPS must risk asses the requirement for Door Supervisors based on events taking place for example sporting fixtures. Should it be felt that Door Supervisors are required there will be a minimum of 2 on duty.
The licence holder will ensure one personal licence holder is on the premises when we serve alcohol past midnight.
CCTV cameras ensure the outside of the building is covered in both directions and the inside and garden is significantly covered by CCTV cameras. There will always be someone present who can replay footage and it is recorded for 14 days.
Anti-drugs posters are displayed in the bar and toilets advising people that anyone found possessing, using or distributing drugs will be banned from the premises and reported to the police.
Anti Drug Deterrent Spray is used on all flat surfaces in the toilets. Door supervisors and staff also complete random toilet checks and drugs searches.
Door supervisors ensure overcrowding is prevented by limiting numbers into the premises.
A member of staff is qualified in first aid and a first aid kit is kept on site.
Fire prevention alarms and equipment are in place and have been inspected by the fire service.
Bar staff keep an eye out on people who may be too drunk and will refuse to serve alcohol if they believe it is in the person's best interest.
Air conditioning is installed to prevent overheating during hot temperatures.
To help reduce noise we ensure the doors are not left open. Bar staff constantly assess noise and will ask bands to reduce the volume if they believe it to be too loud.
Notices are displayed to reminded people to consider our neighbours and leave quietly.
After each shift, staff clean up any litter left outside the property (including cigarette butts).
Take away drinks are served in plastic cups.
Bar staff will always ask for ID if they suspect a person to be under 25 before serving alcohol or are playing on the gambling machines.
Children are not allowed in the bar after 21:00.
