ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
Conditions Consistent with the Justices’ On Licence relating to the premises
1. Intoxicating liquor shall not be sold or supplied except to:
(a) Persons attending Bicton Park Gardens having previously paid an entrance fee.
(b) Persons attending entertainments, dances, dinners and other functions of a private nature held at Bicton Park Gardens.
(c) Persons attending trade, business and other artistic exhibitions held at Bicton Park Gardens.
(d) Persons employed whole or part time at Bicton Park Gardens and bona fide guests of such employees.
2. Intoxicating liquor shall be sold or supplied for consumption on the premises only except in the case of packaged gift items.
Conditions Consistent with the Operating Schedule
1. The sale of alcohol and the provision of music and dancing will remain primarily as ancillary to the use of the premises as a country park tourist attraction.
2. The staff will be trained to a level appropriate to their role by a personal licence holder.
3. The staff will be supervised by a personal licence holder.
4. Senior staff will be encouraged to seek an appropriate licensing qualification and a personal licence where appropriate.
5. A personal licence holder will be on duty whenever possible when the premises are open.
6. The management will ensure that there are adequate staffing levels.
7. All staff will be banned from drinking on duty.
8. Records will be maintained of any material incidents within or in the immediate vicinity of the premises.
9. Drug awareness training will be arranged for staff.
10. The premises will have a zero tolerance to illegal drugs use and dealing.
11. The premises will promote social interaction of customers by charity fundraising, themed events and local community activities.
12. The management will have access to legal advice on all licensing issues.
13. The premises will maintain a policy of banning customers for misbehaviour within or in the vicinity of premises where it is deemed necessary and appropriate.
14. The premises will support Exclusion Orders imposed by courts.
15. There will be a dress code for staff.
16. The premises will have soft drinks, non-alcoholic and/or low alcohol beverages available at all times.
17. Food will be available at the premises.
18. Specific training and supervision will be given in the assessment of customer consumption of alcohol and their condition.
19. CCTV is installed internally covering part of the premises.
20. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
21. Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
22. No drinks hoarding will be allowed.
23. The premises will have a pro-active policy against ‘binge’ drinking.
24. The premises will have a zero tolerance to offensive conduct.
25. Regular glass and bottle collection will be undertaken throughout opening hours.
26. The premises will have no smoking areas in all buildings.
27. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
(The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.).
28. Where temporary electrical equipment is used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and must comply with BS 4293. The device will be tested monthly and the tests will be recorded in a log kept for the purpose.
29. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
30. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
31. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
32. Any oil fired boilers and appliances currently installed on the premises or installed in the future will be inspected and tested annually and an OFTEC certificate of inspection will be obtained.
33. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
34. The emergency lighting with which the premises are provided shall be maintained in efficient working order and be in operation during the whole time that the public are in the premises.
35. The premises shall have adequate toilet facilities to at least the level of minimum hygiene standards.
36. Staff will be given training to at least the level of minimum hygiene standards.
37. There shall be regular dedicated cleaning of premises.
38. Specific hygiene standards will be complied with.
39. The premises will have Health and Safety Risk Assessments for staff and customers.
40. There will be adequate facilities for disabled people.
41. Staff assistance will be available for disabled people.
42. The Designated Supervisor or senior member of staff will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.
43. The telephone numbers of a local taxi firms will be displayed at the premises for the benefit of customers.
44. There shall be nominated staff to deal with complaints from neighbours.
45. The premises shall have an ‘Open-door’ policy towards neighbours.
46. The premises shall have an awareness of ‘sensitive’ and local residential properties.
47. The premises shall have Music up to 50 occasions in a year.
48. There shall be dedicated areas for children.
49. No consumption of alcohol by anyone under the age of 18 years will be permitted.
50. Warning notices will be prominently displayed advising on the under 18 years policy.
52. Full training will be given to staff in the law specifically relating to minors and alcohol and photo identification/ proof of age requirements.
53. The licensable activities authorised by this licence will be confined to the areas that are shaded in PINK on the plan deposited with and approved by the Licensing Authority.
