ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to supply alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in the club premises where they are residing.
Conditions Consistent with the Operating Schedule
1. On Saturdays when the premises are being used for live or recorded music with dancing for members and their guests or on any other occasion when the premises are being used for an occasional event for which a Temporary Event Notice has been obtained and the premises are open to the public for the event. Door Supervisors will be in attendance on the door and such Supervisors will:-
a) Be no less than two (2) in number and used in a ratio to be agreed by the Police and Local Authority.
b) Be on duty from 8:00 pm until 30 minutes after the premises are closed.
c) Be registered with the Security Industry Authority.
d) Display their correct name badge as issued by the Security Industry Authority.
e) Be appropriately dressed in clothing so as to be identified as Door Supervisors.
f) Only engaged in duties relating to the safety and welfare of the persons on the premises and for controlling ingress and egress to the premises
2. CCTV will be operated and maintained to the satisfaction of the Chief Office of Police.
3. Recordings will be kept for 28 days unless prior to the end of that period a request for a longer period for a particular image is made by the Police Authority.
4. If CCTV equipment is inoperative the Police and Local Authority will be informed as soon as practicable and steps taken immediately to restore the equipment into full working order.
5. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
6. A register of names of persons on duty to vet customers and maintain good order at any given time shall be kept on the premises and made available to a Police Officer or a duly authorised officer of the Licensing Authority on request by either of those Officers.
7. No persons carrying open or sealed bottles or glasses will be admitted to the premises nor will persons be permitted to take open containers of alcohol or soft drink from the premises.
8. This is a private members club but when in doubt photographic identification will be requested when in doubt and unless satisfactorily produced service of alcohol to that person will be prohibited.
9. The club and its members do not tolerate the use, possession or supply of illegal drugs on its premises and any person found to have contravened this policy will have his membership suspended and the Police will be informed.
10. No admittance to the premises after 11:00 pm.
11. The fire safety measures with which the premises are provided will be maintained in a good working order and their adequacy will be determined on a regular basis by the carryout of a fire risk assessment. The Officers of the Club are aware and understand that the safety of occupants is also influenced by numbers of persons present, their disposition and the activities taking place and undertake to maintain a safe occupancy level.
12. Any recommendations by the Fire Officer will be observed.
13. All lavatories, water closets or urinals shall at all times be kept in good order and repair and be properly and effectively cleansed, ventilated and disinfected and supplied with water and all necessary requisites and all doors leading to will be suitably marked.
14. There shall be in place a procedure to be followed in the event of a fire and all persons employed to work on the premises shall be aware of the same by way of training and instruction on the procedure to be followed.
15. A member of the Committee so nominated (The Designated Fire Officer) will be responsible for ensuring that any staff are so instructed and trained.
16. All means of escape from the premises shall be kept free from obstruction at all times when the premises is open and be able to be opened easily and immediately without the aid of a key.
17. All steps and stairs shall be maintained with non-slippery and even surfaces with any coverings being secure and maintained so as not to present a danger to persons using the same or when using in the event of escape.
18. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
(The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.).
19. Where temporary electrical equipment is used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and must comply with BS 4293. The device will be tested monthly and the tests will be recorded in a log kept for the purpose.
20. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
21. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
22. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
23. Any oil fired boilers and appliances currently installed on the premises or installed in the future will be inspected and tested annually and an OFTEC certificate of inspection will be obtained.
24. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
25. The Fire Brigade will be called to any outbreak of fire or suspected outbreak of fire.
26. Before carrying out any alterations to the premises to include electrical, gas and structural alterations the Fire Authority will be consulted.
27. All emergency lighting with which the premises are provided shall be maintained in efficient working order and be operative during the whole time that the premises is open.
28. All fire fighting equipment with which the premises are provided shall be maintained in efficient working order.
29. An adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons.
30. The committee undertake to ensure compliance with all relevant Fire Regulations and Health and Safety Regulations to ensure a safe environment for all persons on the premises and to this end a log book is to be kept and in it shall be recorded details of tests and maintenance of fire fighting equipment, fire warning systems, emergency lighting.
31. All necessary steps will be taken by the Committee to ensure that the premises shall not be or become a nuisance to nearby residents or passers by.
32. All external doors and windows will be kept shut other than for access and aggress in all rooms when events involving amplified music or speech or other entertainment are likely to give rise to noise.
33. A member of the Committee or a person so nominated by a member of the Committee will assess the impact of any noisy activities on neighbouring residential premises at the start and periodically during an activity or entertainment and exercise control over any such noise emanating from the premises.
34. No children are permitted to stand at any bar in the premises
35. Any children on the premises must be accompanied and supervised by responsible adult
36. There is no smoking permitted whilst standing at the bar and notices will be in places to this effect.
37. The licensable activities authorised by this licence will be confined to the areas that are hatched in PINK on the plan deposited with and approved by the Licensing Authority.
