ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by any person residing on the premises of alcohol whilst the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
2. Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
Conditions Consistent with the Operating Schedule
1 Theatrical events with an adult theme shall be evening entertainment only and children will be excluded.
2 All events held at the premises shall be by invitation or entry by ticket only.
3 CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and the Licensing Authority.
4 A notice will be displayed at the entrance to the premises advertising that CCTV is in operation.
5 The Licensee shall keep an ‘Incident Report Register’ to the satisfaction of the police and the Licensing Authority, in which full details of all occurrences of violent and/or disorderly conduct involving patrons of the premises are recorded. The Register is to be kept on the premises at all times and shall be made available for inspection by a police officer or duly authorised officer of the Licensing Authority. Registers shall be retained for at least 12 months from the last entry.
6 Consideration will be given to setting capacity limits to prevent overcrowding which could lead to crime and disorder these being 120 maximum for functions and 250 maximum for outdoor theatre performances.
7 Sales of alcohol to non residents shall be for consumption on the premises only.
8 The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. A competent person will be a qualified electrician who is registered with the ECA or NICEIC.
9 Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
10 Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
11 The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
12 The oil fired boilers and appliances will be inspected and tested annually and an OFTEC certificate of inspection will obtained
13 All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
14 All staff will receive suitable training as to what to do in an emergency and in general safety precautions.
15 All alcoholic and soft drinks which are taken outside the premises will be served in plastic or toughened glasses.
16 Free drinking water will be available at all times.
17 When disabled people are present, adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
18 The fire safety measures with which the premises are provided, will be maintained in good working order, and their adequacy will be determined on a regular basis, by the carrying out of a fire risk assessment as required by, and in accordance with the Fire Precautions (Workplace) Regulations.
19 Sufficient numbers of staff and stewards who are suitably trained will be provided on the premises to seat and assist guests at theatrical performances.
20 Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
21 The management will control sound levels of music/entertainment
22 To prevent entertainment being intrusive, noise emanating from the premises will not be clearly audible one metre from the façade of the nearest residential property.
23 Theatrical performances shall take place outside on no more than three occasions in any calendar year.
24 A proof of age policy agreed by the police and local authority will be enforced.
25 Children will be excluded from any event of an adult nature
26 All children on the premises shall be supervised at all times by a responsible adult over 18 years of age.
27 The hotel drawing room to be excluded from all public entertainment events and the service of alcohol.
28 The extent of the area within which the various licensable activities will be permitted is as shown outlined in red on the plan accompanying the licence.
