ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the permitted hours, the taking of alcohol supplied in the premises from the premises unless the alcohol is supplied or taken in an open vessel.
9. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the premises.
10. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption ancillary to the meals.
11. No licence is required for the provision in the premises of public entertainment by the reproduction of wireless (including television) broadcasts or programmes included in any programme service (within the meaning of the Broadcasting Act 1990) other than a sound or television broadcast service or of public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound.
12. The sale by retail/supply of alcohol will be confined to the area(s) outlined in BLUE on the plan(s) approved by and deposited with the Licensing Authority.
Additional Conditions Consistent with the Premises Operating Schedule
1. The 30 minutes ‘drinking up’ time will allow the appropriate dispersal of customers from all public areas of the premises including the toilets.
2. When there is insufficient natural light the external lighting shall be kept switched on at all times when the premises are being used by the public.
3. The majority of the customers are local people and are well known to the licensees.
4. There is a rota system in place for checking the toilets.
5. The licensees or staff will monitor the behaviour of customers to ensure that there is no crime and disorder and that the conditions of the Licensing Act are complied with, especially during busy periods.
6. All staff involved in the preparation or handling of food will hold Basic Food Hygiene certificates.
7. There will always be a minimum of two staff on duty at any one time.
8. The access to the toilets is clearly visible from the bar area.
9. A full range of soft drinks will be available for purchase on the premises.
10. The premises will maintain a health and safety policy which will be adhered to and reviewed on a quarterly basis.
11. All fire fighting equipment with which the premises are provided shall be maintained in efficient working order and inspected annually
12. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
13. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
14. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
15. A pest control contract is in place.
16. The licensee promotes a licensed taxi service to facilitate customers making on ward journeys.
17. The licensee complies with the smoking charter.
18. There is an accident/incident book on site which will be used when required on matters which involve either the staff or customers.
19. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies. These include Health and safety certificates and health and Hygiene certificates.
20. Management will control the sound levels of the live and amplified music.
21. The building is at the end of a terrace, it is brick built and has good sound-insulating qualities.
22. All of the doors and windows are lockable.
23. There is no television thus eliminating a potential source of noise and boisterous behaviour.
24. Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
25. No unaccompanied children will be allowed on the premises.
26. There will be no AWP machines on the premises.
27. Children are not allowed in the bar area.
