  1.              a)              There shall be no sale or supply of alcohol when there is no designated premises supervisor in respect of this premises licence or at a time when the said premises supervisor does not hold a personal licence or when his/her licence is suspended.

  b)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  2.                            Any person used to carry out a security activity as required under Annexe 3 condition 2 must be licensed by the Security Industry Authority.

  ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Embedded Conditions Consistent with the Licensing Act 1964

   

  1        The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.

  2        The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.

  3        The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises or the despatch by the vendor of the alcohol so ordered.

  4        The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.

  5        The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.

  6        The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

  7        The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.

   

  Conditions Consistent with the Operating Schedule

   

  1.              A Personal Licence holder will be on the premises at all times when they are open for business.

  2.              All staff to receive ‘in house’ training on licensing issues.

  3.              A strict no drugs policy will be operated.

  4.              Adequate lighting will be provided.

  5.              Persons under 18 years of age will be permitted in the bar area only for the purpose of gaining access to the restaurant and only if provided with a meal there.

  6.              Plastic glasses will be used during any major events.

  7.              Individuals who appear to be drunk will not be supplied with alcohol.

  8.              Four ground floor exists are in existence and will be maintained.

  9.              A First Aid box will be kept in the kitchen for public use.

  10.              All Fire extinguishers will have up to date annual inspection certificates.

  11.              All escape routes will be kept clear.

  12.              All spillages and breakages will be cleared up immediately.

  13.              All external doors and windows must be kept shut, other than for access and egress.  This is in order to limit the noise and disturbance affecting the surrounding areas

  14.              All litter and refuse will be kept in containers away from highway (locked in rear yard) and collected weekly.

  15.              No alcohol will be supplied to under 18’s.

  16.              Persons under 18 years of age will not be permitted in the bar area except for the purpose of gaining access to the restaurant and only if provided with a meal there.

  17.              No under 18's will be allowed to use fruit machines.

  18.              A strict proof of age policy will be in place.  Appropriate signage will be displayed and any person who appears to staff to be under 21 years of age will not be served until acceptable proof of age has been provided.

  19.              The licensable activities authorised by this licence will be confined to the area outlined in RED on the plan deposited with and approved by the Licensing Authority.

  ANNEXE 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  1.              CCTV  will be -

  a)              Will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.

  b)              Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Local Authority).

  c)              If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.

  d)              A notice will be displayed at the entrance to the premises advising that CCTV is in operation.

  c)              CCTV will be installed to monitor the Lyme Street frontage and all internal licensable areas with the monitor being located in the bar area to facilitate control.

  2.              Suitable door staff registered with the Security Industry Authority to be employed from 9.00 pm until 30 minutes after the end of the permitted hours on any day that live music or recorded music and any entertainment of a similar nature is planned to take place on the premises with event being open to the public and continuing after midnight.

  3.              All door staff will:

  a)              Be correctly registered with the Security Industry Authority.

  b)              Display the correct name badge.

  c)              Carry proof of registration.

  d)              Be used at a ratio to be agreed by the Police and Local Authority which is currently 1:75.

  e)              Will wear clothing that can be easily and clearly identifiable on CCTV - i.e. will wear a reflective number between 1 and 99 (at least 100mm high) in a prominent position on the upper part of the body.

  4.              The Licensee will make arrangements to install and maintain a noise limiter in the area used for music to the satisfaction of East Devon District Council’s Environmental Health Department.

  5.              Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.

  6.              Membership of the local Licensees Association shall be maintained.

  7.              A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment.

  8.              Suitable signage at the exit to request the co-operation, of patrons in particular, to make as little noise as possible when leaving the premises.

  9.              Bottle skips and bins containing cans or bottles will not be emptied outside after 10.00 pm or before 8.00 am, but will be dealt with the next day during normal office hours.

  10.              Patrons will be asked not to stand around talking in the street outside the premises or any car park and asked to leave the vicinity quickly and quietly.
