• ANNEXE 1 - MANDATORY CONDITIONS

   

  1.              a)              There shall be no sale or supply of alcohol when there is no designated premises supervisor in respect of this premises licence or at a time when the said premises supervisor does not hold a personal licence or when his/her licence is suspended.

  b)              Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

  2.                            Any person used to carry out a security activity as required under Annexe 3 condition must be licensed by the Security Industry Authority.

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  1        The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.

  2        The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader for the purposes of their trade or to a club with a Club Premises Certificate for the purposes of the club.

  3        The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.

  4        The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.

  5        The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.

  6        The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.

  7        The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.

  8        The sale by retail/supply of alcohol will be confined to the area as outlined in red on the attached plan.

  9        Personal licensee on premises at all times save in exceptional circumstances.

  10    All staff ‘in house’ training on licensing issues.

  11    Strict no drugs policy to continue.

  12    Continue to provide adequate lighting.

  13    Strict no under 18 at the bar area policy.

  14    When very busy plastic glasses are provided.

  15    Strictly no alcohol to individuals who appear to be drunk

  16    4 ground floor exists in existence.

  17    First Aid box kept in the kitchen for public use.

  18    Fire extinguishers with up to date inspection certificates.

  19    Escape routes kept clear.

  20    Spillages and breakages cleared immediately.

  21    Windows kept closed after hours 21.30 when live music or disco provided.

  22    Litter and refuse kept in container away from highway (locked in rear yard) collected weekly.

  23    No alcohol to under 18’s

  24    No under 18's in bar area - only in restaurant area if provided with a meal there.

  1         No under 18's are allowed to use fruit machines (as in bar area).

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  1        CCTV  will be -

  )          Will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.

  )          Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Local Authority).

  )          If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.

  )          A notice will be displayed at the entrance to the premises advising that CCTV is in operation.

  )          CCTV will be installed to monitor the Lyme Street frontage and all internal licensable areas with the monitor being located in the bar area to facilitate control.

  2.              Suitable door staff registered with the Security  Industry Authority to be employed from 09.00 pm until 30 minutes after the end of the permitted hours on any day that live music or recorded music and any entertainment of a similar nature is planned to take place on the premises with event being open to the public and continuing after midnight.

  All door staff will:

  )          Be correctly registered with the Security Industry Authority.

  )          Display the correct name badge.

  )          Carry proof of registration.

  )          Be used at a ratio to be agreed by the Police and Local Authority which is currently 1:75.

  )          Will wear clothing that can be easily and clearly identifiable on CCTV - i.e will wear a reflective number between 1 and 99 (at least 100mm high) in a prominent position on the upper part of the body.

  3.              The Licensee will make arrangements to install and maintain a noise limiter in the area used for music to the satisfaction of East Devon District Council’s Environmental Health Department.

  4.              Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.

  5.              Membership of the local Licensees Association shall be maintained.

  6.              A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment

  7.              Suitable signage at the exit to request the co-operation, of patrons in particular, to make as little noise as possible when leaving the premises.

  8.              Bottle skips and bins containing cans or bottles will not be emptied outside after 10.00 pm or before 8.00 am, but will be dealt with the next day during normal office hours.

  9.              Patrons will be asked not to stand around talking in the street outside the premises or any car park and asked to leave the vicinity quickly and quietly.
