ANNEX 2 - CONDITIONS CONSISTANT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8. The sale by retail/supply of alcohol will be confined to the area(s) as outlined in RED on the plan accompanying the licence.
Conditions Consistent with the Premises Operating Schedule
1. The premises will be run and operated in a manner consistent with the Operating Schedule served on the Licensing Authority at the time of the application for this licence.
2. We have applied for an extended period between the cessation of the supply of alcohol and the closure of the premises to give us the option to allow for a more gradual dispersal of customers.
3. The style and operation of the public will not differ significantly during the extended hours.
4. Where it is appropriate, non-alcoholic refreshment will be available in the extended period.
5. The premises will respect Spirit Group’s Approach to Responsible Drinking.
6. When door staff are used they will be Security Industry Authority (SIA) approved and operate in accordance with the security industry guidelines.
7. A zero tolerance towards illegal drugs will be enforced at all times.
8. If a disc jockey is used on any night then he/she will ask customers to leave quietly.
9. Where a CCTV system is installed, it will continue to operate during the additional hours of trading and notices will be displayed.
10. All instances of crime and disorder will be reported to the police and will be kept in an incident log book.
11. Public safety is integral to the way that the Spirit Group runs its business and is reviewed regularly through our health and safety policy.
12. This policy is fully briefed and trained to all management and staff and we will continue to train our staff to the standards required by relevant legislation.
13. Free drinking water will be available at all times.
14. Additional internal and external patrols will be undertaken by members of staff to limit any noise pollution when entertainment is being offered within the premises.
15. Notices will be displayed asking our customers to respect our neighbours when leaving the premises.
16. Where already used text/radio pagers will continue to be used for the additional hours of trading and will be monitored by a responsible member of staff.
17. Soft drinks and non-alcoholic refreshment will be available if we decide to use the option to stay open for an extended period between the cessation of the supply of alcohol and the closure of the premises.
18. When children are allowed in the premises, any entertainment offered within the premises will be suitable for young persons.
19. Children under 16 years of age will be required to be supervised by the accompanying adult at all times.
20. A no smoking area will be provided.
21. Soft drinks and non-alcoholic drinks will be available at all times when the premises are open.
22. A recognised Proof of Age Policy will be enforced.
23. Whenever live music is performed the number of entertainers/musicians will be limited to no more than two.
