ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. Alcohol shall not be sold or supplied:
(i) Unless the premises have been structurally and bona fide used, or intended to be used, for the purposes of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises; and unless the premises are bona fide used, or intended to be used, for the purposes of habitually providing for reward board and lodging, including breakfast and at least one other of the customary main meals;
(ii) On the premises otherwise than to persons taking table meals there and for consumption by such a person as an ancillary to their meal, or
to persons residing there or their private friends bona fide entertained by them at their expense, and for consumption by such a person or their private friends so entertained by them either on the premises or with a meal supplied at but to be consumed off the premises.
2. The times permitted to sell alcohol do not prohibit or restrict the sale or supply to, or consumption by, persons residing on the premises or their private friends bona fide entertained by them at their own expense, and for consumption by such a person or their private friends so entertained by them either on the premises or with a meal supplied at but to be consumed off the premises.
3. Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
4. There shall be afforded in the premises, for persons provided with a board and lodging for reward, adequate sitting accommodation in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or for the supply or consumption of intoxicating liquor.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
6. The licensable activities authorised by this licence will be confined to the areas that are outlined in PINK on the plan deposited with and approved by the Licensing Authority. The residential area for the sale/supply of alcohol to hotel residents for on and off the premises will relate to the whole building as shown on the deposited plan.
