ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The sale of alcohol of all descriptions is authorised by this Licence.
2. Alcohol shall not be sold in an open container or be consumed in the licensed premises.
3. The times permitted to sell alcohol do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
4. The times permitted to sell alcohol do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
5. The times permitted to sell alcohol do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
6. The times permitted do not prohibit or restrict, during the first twenty minutes after permitted hours, the taking of alcohol from the premises, unless the alcohol is supplied or taken in an open vessel.
Conditions Consistent with the Premises Operating Schedule
1. CCTV must be installed, operated and maintained to the satisfaction of the Licensing Authority and the Chief Officer of Police in accordance with the requirements set out in the EDDC Licensing Policy.
2. CCTV images must be retained for a minimum of 14 days and to be produced on the request of the Police or a Licensing Officer of East Devon District Council. Recording media must be set to 25 frames per second.
3. The CCTV system must be operational at all times whilst the premises are trading. If the system is faulty or not working then the Police and East Devon Licensing Service must be informed immediately. Details of the malfunction must be recorded in the premises incident book.
4. A4 sized warning notices must be displayed in public areas of the premises and at all entrances advising that CCTV is in operation. The signs located at entrances should be located on the exterior of the building at, and adjacent to, all public access doors. All signs must comply with the requirements of the Data Protection Act 2002.
5. A challenge 25 policy must be employed where those individuals who appear to be under the age of 25 attempting to purchase alcohol must be asked for identification. The only type of identification that will be accepted is PASS accredited ID, passport or photo driving licence.
6. An incident log (whether kept in a written or electronic form) must be retained at the premises and made available to an authorised Officer of the Police or the Local Authority.
7. The premises must be fitted with a burglar alarm system.
8. The premises must be fitted with a panic button system for staff to utilise in the case of an emergency.
9. The premises licence holder must ensure that the appropriate fire safety, and health and safety regulations are applied at the premises.
10. The premises licence holder will endeavour to eliminate or minimise any nuisance arising out of its licensable activities. In doing so the premises licence holder will work with enforcement authorities where any issues are identified. A complaints procedure will be maintained in order that local residents have a means of contact if necessary.
11. All staff must receive comprehensive training in relation to age restricted products and in particular the sale of alcohol. No member of staff will be permitted to sell age restricted products until such time as they have successfully completed the aforementioned training.
12. An age till prompt system must be utilised at the premises in respect of age restricted products.
13. A refusals register (whether kept and written or electronic form) must be maintained at the premises and will be made available for inspection upon request by an authorised Officer of the Police or the Local Authority.
