ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
Conditions Consistent with the Premises Operating Schedule
1. The maximum occupancy figures for inside the premises will be in agreement with the Licensing Authority and Devon Fire and Rescue Service, based on the Fire Safety Issues, Available Floor Space and the Sanitary Accommodation available.
2. Adequate supervision will be exercised over the premises and grounds by staff/CCTV.
3. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
4. Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Local Authority).
5. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
6. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
7. All staff will be trained in licensing matters and emergency procedures.
8. The premises will operate an exclusion policy in line with the local pubwatch or Licensees Association scheme.
9. An incident book will be maintained and details will be recorded of all incidents of crime and public disorder and will be made available for inspection by officers of the relevant statutory bodies.
10. No customers carrying open bottles or glasses will be admitted to the premises at any time.
11. No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
12. All bottles and glasses will be removed from public areas as soon as practicable when they are finished with.
13. Any person who appears to be over 16 years of age but under the age of 18 years of age will only be supplied with intoxicating liquor when it is ancillary to the consumption of a table meal (accompanied by a person over the age of 18).
14. In all other circumstances any person who appears to be under the age of 18 attempting to purchase alcohol will be required to provide proof of age.
15. A proof of age policy agreed by the police and local authority will be enforced.
16. Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
17. There will be a 30 minute drinking-up time prior to the premise closing when alcoholic beverages will not be supplied.
18. Crime prevention notices will be displayed in a prominent position at entrances/exits warning customers of the prevalence of crime which may target them e.g. ‘bags/coats should not be left unattended.
19. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety. (The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC).
20. Where temporary electrical equipment is to be used, a suitable circuit breaker device will be installed to cover this equipment.
21. The circuit breaker should operate at a current not exceeding 30 MA and should comply with BS 4293.
22. The device will be tested monthly and tests will be recorded.
23. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitable qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or where applicable BS7909.
24. The electrical system, including portable appliances will be inspected and tested annually by a competent person to ensure safety. A competent person will be a qualified electrician who is registered with the ECA or NICEIC.
25. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
26. Staff will have proper training in all emergency procedures.
27. All accesses, doors and common areas will be regularly checked by staff throughout the hours of trading.
28. Qualified First Aiders will be available on the premises.
29. An adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons.
30. All recommendations of the Devon and Somerset Fire and Rescue Service or other Responsible Authorities will be acted upon.
31. The provision of plastic glasses and bottles will be reviewed depending on the type of entertainment provided, the number and behaviour of patrons.
32. The exterior of the premises will be checked periodically by the management or senior staff to prevent noise nuisance.
33. All recommendations of the Local Authority Officers concerning noise pollution, health and safety or other matters will be considered.
34. A senior member of staff (manager) will assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/ entertainment and periodically thereafter.
35. A policy requesting patrons to leave the area quickly and quietly will be introduced and maintained.
36. All deliveries, as far as possible, will be timed to ensure the least disturbance to nearby residents.
37. Suitable signage will be prominently displayed at the exit to request the co-operation of patrons, in particular, to make as little noise as possible when leaving the premises.
38. All external doors and windows will be kept shut, other than for access or egress in all rooms when events involving amplified music or any other entertainment give rise to noise.
39. In the event of all windows and doors being closed to prevent a noise breakout a suitable air ventilation system will be operated.
40. Staff will check prior to entertainment and periodically during the entertainment that all windows and doors are kept shut.
41. All deliveries, as far as possible, to the premises will be timed to ensure the least disturbance to nearby residents.
42. Children will only be admitted in company of an appropriate adult over the age of 18 years.
43. All staff will receive appropriate training in matters concerning children.
