ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to supply alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in the club premises where they are residing.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the club premises.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the permitted hours, the taking of alcohol supplied in club the premises from the premises unless the alcohol is supplied or taken in an open vessel.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the club premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
Conditions Consistent with the Operating Schedule
1. The maximum occupancy figures for the premises will be 110. In agreement with the Licensing Authority and Devon Fire and Rescue Service based on fire safety issues, available floor space and the sanitary accommodation available.
2. We will employ an appropriate method for checking the number of people entering and leaving the premises and ensure that steps are taken so that, once the maximum occupancy is reached, no further persons are admitted. The method employed will be by door stewards on Saturday evenings and any other occasion when it is known that many people will be visiting the club.
3. A security camera will be sited in the entrance hall of the club so that bar staff can monitor persons entering or leaving the club.
4. Staff will be trained to be aware of their duties under the Licensing Act 2003 and in particular the importance of complying with this Act and ensuring that customers comply with it and with the requirements of the criminal law.
5. The fire safety measures, with which the premises are provided, will be maintained in good working order, and their adequacy will be determined on a regular basis, (annually) by the carrying out of a fire risk assessment, as required by, and in accordance with the Fire Precautions (Workplace) Regulations. The applicant understands that the fire safety of occupants is also influenced by the numbers of persons present, their disposition and the activities taking place, and therefore undertakes to maintain a safe occupancy level.
7. The club constitution includes rules governing the conduct of members and their guests within the club premises.
8. Admission to the club is confined to members and bona fide guests and controlled by a computerised door entry system.
9. Anyone attempting to enter the club without a door entry card will be scrutinised via CCTV and an audible link before being admitted.
10. Club employees will be instructed not to admit or serve members or guests who behave in a drunken or disorderly fashion.
11. Misconduct will be reported to the committee to consider action under the club’s disciplinary rules.
12. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
13. (The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
14. Where temporary electrical equipment is used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and must comply with BS 4293. The device will be tested monthly and the tests will be recorded in a log kept for the purpose.
15. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
16. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
17. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
18. Any oil fired boilers and appliances currently installed on the premises or installed in the future will be inspected and tested annually and an OFTEC certificate of inspection will be obtained.
19 All safety certificates and inspection reports will be kept on site and made available for inspection by officers or relevant statutory bodies.
20. When disabled people are present, adequate arrangements will exist to enable their safety evacuation in the event of an emergency.
21. The air management system within the premises will be used at all times the club is open to members and during entertainment as there will be insufficient ventilation, when all windows and doors are closed, to prevent noise break out. Mechanical ventilation, air purification is provided.
22. All external doors and windows will be kept shut, other than for access and egress, in all rooms when events involving amplified music or speech or other entertainment are likely to give rise to noise.
23. Special effects, such as strobe lighting, smoke, foam, lasers, pyrotechnics, dry ice or bubbles will not be used.
24. On operation of the fire alarm system all electrical power to any entertainers will be automatically switched off by an isolation switch incorporated into the system.
25. An adequate and appropriate supply of first aid equipment and materials will be available for the use of patrons and staff.
26. Suitable protective equipment will be provided to deal with blood spillages and other body fluids. Procedures will be in place to ensure that body fluids are dealt with in a safe manner to avoid the risk of communicable disease.
27. Exit routes and steps will be maintained in good order with non slippery and even surfaces; edges of steps and stairways will not be conspicuously marked as they are all provided with both, mains operated and emergency lighting.
28. Where glazing forms part of a door or side panel at below shoulder height, it is constructed of safety materials.
29. Door staff/stewards, who will be suitably trained, will be provided on the premises depending on the activities or entertainment taking place on site and the likelihood of overcrowding.
Such doorstaff will:
(a) Be correctly registered with the SIA
(b) Display the correct name badge
(c) Carry proof of registration
(d) Be used at a ratio to be agreed by the Police and Local Authority, which is currently 1:75
(e) A female supervisor will be available if searches are to be conducted on female customers
(f) Will wear clothing that can be easily and clearly identifiable on CCTV - i.e. wear a reflective number between 1 and 99 (at least 100mm high) in a prominent position on the upper part of the body.
30. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
31. Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Local Authority).
32. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
33. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
34. All staff will receive training as to what to do in an emergency and in general safety precautions.
35. The manager or a member of staff will check the premises prior to opening to ensure there are no risks to patrons and that all safety precautions are in place.
36. Regular glass and bottle collection will be undertaken throughout opening hours.
37. A means of addressing patrons during operating hours, which can be heard above entertainment to make important safety announcements, will be installed.
38. Club members/guests and staff will not be exposed to an event Leq 107dB(A) and the peak sound pressure level does not exceed 140 dB.
39. The first safety measure with which the premises are provided, will be maintained in good working order, and their adequacy will be determined on a regular basis, by the carrying out of a fire risk assessment, as required by, and in accordance with the Free Precautions (Workplace) Regulations
40. I understand that the safety of occupants is also influenced by numbers of persons present, their disposition and the activities taking place, and therefore undertake to maintain a safety occupancy level.
41. The sanitary accommodation consists of:
Male WCs 2 Female WCs 2
Male urinals 2 WHBs 2
WHBS 2
42. The club will comply with Health and Safety and Fire Safety Precautions regulations.
43. Fire Action notices will be displayed and emergency escape routes will be clearly indicated by signage.
44. All external doors and windows are kept shut, other than for access and egress.
45. All doors and windows are otherwise kept closed when events involving amplified music or speech or other entertainment are likely to give rise to noise.
46. Suitable signage is sited at the exit to request the co-operation, of patrons in particular make as little noise as possible when leaving the premises.
47. Suitable signage will be displayed in the garden areas requesting patrons to respect the amenities local residents.
48. The emergency exits are well fitted and will be kept shut during opening hours.
49. A small number of taxi operators details are displayed adjacent to the public telephone for staff and customers use.
50. Taxi company telephone numbers will be advertised to customers.
51. The operator and all drivers are aware that they should arrive and depart as quietly as possible, should not sound vehicle horns as a signal of their arrival or leave engines idling unnecessarily.
52. Staff will be advised to leave as quietly as possible, particularly at night and early in the morning.
53. Staff/duty committee person will make a check prior to any entertainment commencing, and periodically during the entertainment, that all windows and doors are shut.
54. The Manager and duty committee person will control the sound levels of the music/entertainment to prevent entertainment being obtrusive, noise emanating from the premises is not be clearly audible 1 metre from the façade of the nearest residential development.
55. Between 11.00 pm and 12 midnight on those occasions when the club will be open after 11 pm (Christmas Eve etc) to prevent entertainment being intrusive, noise emanating from the premises will not be clearly distinguishable above background levels and will not cause a statutory nuisance.
56. The mechanical ventilation and air conditioning system does not allow noise breakout from the premises or cause a nuisance
57. Cooling plant/machinery has been positioned in such a way that the building structure provides as much screening as possible for nearby residential property. In addition, an acoustic enclosure with acoustic louvers has been installed.
58. Regular maintenance is carried out on the plant to ensure that noise disturbance from such sources does not occur.
59. The delivery of goods is restricted to the normal working day. (To limit the likelihood of noise nuisance).
60. The handling of beer kegs, bottles and other similar items will not take place in the late evening, at night or during the early morning, when the noise generated could cause a nuisance.
61. The refuse bins containing cans or bottles will not be emptied outside after 10.00 pm, but will be dealt with the next day during normal office hours.
62. The movement of bins and rubbish outside the premises will not take place after 10.00 pm.
63. Staff and committee members will monitor the use of the car park to ensure patrons do not congregate in this area and cause annoyance to neighbours.
64. All the rubbish produced by the premises will be stored securely in a designated bin with a tight fitting heavy lid.
65. The use of lighting in external areas will be provided and maintained for health and safety reasons and is never intrusive to residential properties.
66. Persons under the age of 18 are only allowed into the club if accompanied by an adult.
67. No one is permitted to be a member of the club if they are under the age of 18.
68. The door entry control system, staff members and committee members are instructed in the offence provisions of the Licensing Act 2003 relating to alcohol and children.
69. Signs will be displayed prohibiting the supply of alcohol to children under 18 years of age.
70. Persons under the age of 18 are not allowed to be in the bar area.
71. Notices will be displayed in the vicinity of any jackpot gaming machines installed in the premises prohibiting use by persons under the age of 18 years.
72. The gaming machines will be sited adjacent to the bar, surveillance of them is exercised by the bar manager and committee members.
73. The licensable activities authorised by this licence will be confined to the areas that are shaded in PINK on the plan deposited with and approved by the Licensing Authority.
