AMENDMENTS REQUESTED BY MINOR VARIATION
Add to Annexe 2 Condition 24 "This does not apply to the first floor balcony shown on the plan."
Replace the last sentance of Annexe 2 Condition 29 with "This does not apply to the first floor balcony shown on the plan"
Add to the end of Annexe 3 Condition 2 "except for the two sets of doors to the balcony at the bar end of the clubroom"
Add to Annexe 2 Condition 20 "To facilitate this, a sound limiting system will be installed with levels set by the Environmental Health Authority Officials".
ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The principal use of the premises must be and shall remain that of a private members club.
2. Access to the premises by non-members must be limited by the application of the club rules. Any non-members will be bona fide guests, visiting yachtsmen or yachtswomen, families and friends of guests attending sailing events, training courses, presentations and talks or invitees to pre-booked functions.
3. Responsible and mature members of the club must always be in attendance when the premises are open and licensable activities are taking place to monitor the behaviour of members and guests.
4. An appropriate method agreed in writing by the Licensing Authority must be employed for checking the number of people entering and leaving the premises and ensuring that once maximum occupancy is reached, no further persons are admitted.
5. A ticket sales procedure must be used for controlling the number of people attending set functions.
6. Irresponsible drinks promotions must not be permitted, and the Standards for the Management of Responsible Drinks promotions including Happy Hours produced by the British Beer and Pub Association will be complied with.
7. The licence holder (club committee) or person authorised by the licence holder must check the premises prior to its opening to the public in order to ensure there are no risks to patrons and that all safety precautions are in place.
8. The licence holder (club committee) must ensure that all staff receive appropriate training regarding emergency and general safety precautions and procedures.
9. The licence holder (club committee) must ensure all staff are aware of the social and legal obligations and their responsibilities regarding the sale of alcohol.
10. Free drinking water must be made available at all times that the premises are open to the public.
11. The telephone numbers of local taxi operators must be prominently displayed at the premises for the benefit of customers.
12. All bottles and glasses and rubbish must be removed from public areas on a regular and frequent basis.
13. The electrical system at the premises, including portable appliances must be inspected and tested annually by a competent person and a satisfactory safety report obtained.
14. The Gas System, including appliances, must 'be inspected annually and tested by a CORGI registered gas engineer and a satisfactory Gas Safety Certificate must be obtained.
15. All safety certificates and inspection reports must be kept on site and made available for inspection by officers of relevant statutory bodies.
16 The fire safety measures with which the premises are provided must be maintained in good working order and their adequacy will be determined on a regular basis, by the carrying out of a fire risk assessment as required by and in accordance with the Regulatory Reform (Fire Safety) Order 2005.
17. The licence holder (club committee) must ensure that staff or club officers regularly patrol the premises both indoors and out to supervise the orderly conduct of patrons.
18. All potentially noisy activity must be concentrated on the seaward/estuary side of the clubhouse away from neighbours.
19. Prominent, legible notices requesting people to leave the premises and the area quietly must be displayed at all exits.
20. The licence holder (club committee) must control the volume of regulated entertainment taking place at the premises.
21. No music or speech is permitted to be played on external speakers without the written consent of the Licensing Authority.
22. Suitable signage must be displayed in the outside areas requesting patrons to respect the amenities of local residents.
23. Where outside areas are provided for patrons facilities for the depositing and collection of litter must be maintained.
24. Where drinks are to be consumed in outdoor areas they must be served in plastic or toughened glass.
25. A proof of age policy agreed in writing by the Licensing Authority must be enforced.
26. Only plastic glasses or plastic bottles will be permitted in outside recreational areas or in any area where customers are required to remove footwear.
27. Any restrictions on the admission of children to the premises must be displayed outside the premises.
28. The permitted licensing hours on Sundays through to Thursdays for all licensable activities approved for this licence may be extended on a maximum of 15 days a year by up to one hour from 11:00 pm until 12 midnight. The permitted licensing hours for Fridays, Saturdays and New Year’s Eves are unaffected by this condition.
29. The consumption of alcohol outdoors must only be permitted within the areas shown hatched RED on the plan submitted to and approved by the Licensing Authority. The drinking area shall be marked out by temporary barriers and consumption of alcohol shall cease at 10.30p.m. The 10.30 pm restriction on the consumption of alcohol also applies to the club house balcony on the first floor.
30. The licensable activities authorised by this licence will be confined to the areas as outlined in RED on the plan deposited with and approved by the Licensing Authority.
