ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to supply alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in the club premises where they are residing.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the club premises.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the club premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
Conditions Consistent with the Operating Schedule
1. The following occupancy figures are guidelines based on fire safety issues, floor space and sanitary accommodation available, reviewed at fire inspections by The Devon Fire and Rescue Service.
a) The maximum number for seated members in the bar lounge and dining area is 100.
b) The maximum number for general use in the bar lounge and dining area covering seated and standing is 120.
c) The maximum number for general use downstairs is 60. (Not including the outside covered area).
2. We will use a ticket sales procedure for controlling the number of people attending set functions within the club.
3. Only paid up valid club members may purchase an alcoholic drink using a valid ‘smart card’.
4. Club members will be vetted, proposed and seconded prior to being approved for membership by the management committee.
5. The club membership is limited to 500.
6. There are procedures in place to expel any member who behaves inappropriately on the club premises.
7. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
(The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
8. Where temporary electrical equipment is used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and must comply with BS 4293. The device will be tested monthly and the tests will be recorded in a log kept for the purpose.
9. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
10. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
11. The Gas System, including appliances, will be inspected and tested by a CORGI registered gas engineer annually and a satisfactory Gas Safety Certificate will be obtained.
12. Any oil fired boilers and appliances currently installed on the premises or installed in the future will be inspected and tested annually and an OFTEC certificate of inspection will be obtained.
13. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
14. The fire detection system and the fire fighting equipment is regularly tested and recorded in accordance with the Devon Fire and Rescue Services recommendations.
15. The fire safety measures, with which the premises are provided, will be maintained in good working order, and their adequacy will be determined on a regular basis, by carrying out a fire risk assessment.
16. We understand that the safety of occupants is also influenced by numbers of persons present, their disposition and the activities taking place, and therefore undertake to maintain a safe occupancy level.
17. Free drinking water will be available at all times.
18. The premises including the toilets and showers are cleaned regularly and especially during and after each major event.
19. The sanitary accommodation consist of:-
Male WC’s - 2 Male urinals - 4 Male showers - 6
Female WC’s - 4 Female showers - 2
Disabled toilet - 1 Baby changing facility - 1
20. The stair lift to aid the infirm and disabled up to the bar and dining room will be maintained.
21. There will be a first aid facility maintained and positioned inside the main doors.
22. Emergency exits and routes will be maintained and kept clear.
23. Handrails will be provided at raised areas.
24. A large bell is be situated at the bar is used to attract general attention.
25. The club will operate a ‘no smoking’ policy.
26. The club will operate a friendly neighbour policy where immediate neighbours are notified in advance of any activity that could lead to concern such as noise.
27. All potentially noisy activity will be concentrated on the seaward side of the clubhouse, away from the neighbours.
28. All members will be frequently reminded to respect the noise level when leaving the club at night.
29. Regular littler patrols will be carried out around the club premises.
30. Waste, bottles, cans and cardboard will be stored for collection and recycling in discreet specified areas.
31. No underage person will be issued with a bar ‘smart card’ allowing them to purchase an alcoholic drink.
32. Only club members who have passed a CRB check will supervise any club activity involving young club members.
33. The licensable activities authorised by this licence will be confined to the areas that are outlined in RED on the plan deposited with and approved by the Licensing Authority. The outside area hatched in RED will not be authorised for licensable activities and will be for consumption of alcohol only.
