ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to supply alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in the club premises where they are residing.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the club premises.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the permitted hours, the taking of alcohol supplied in club the premises from the premises unless the alcohol is supplied or taken in an open vessel.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the club premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
Conditions Consistent with the Premises Operating Schedule
1. The maximum occupancy for the Main Club area will be 200 and the Skittle Alley area will be 100.
2. A notice will displayed informing customers that if they act in an inappropriate manner they could be barred from the premises.
3. A crime prevention notice will be displayed warning customers of the prevalence of crime which may target them, e.g. "bags should not be left unattended".
4. The club will be a member of Pubwatch or an alternative local Licensees’ Association and representative will attend Pubwatch or association meetings and participate in all initiatives.
5. All incidents of public disorder will be brought before the General Committee at the Committee’s next monthly meeting.
6. No customers will be permitted to take open containers of alcoholic or soft drinks from the premises.
7. All bottles and glasses will be removed from the public areas as they are finished with or empty.
8. The General Committee will not permit irresponsible drinks promotions.
9. Use of controlled drugs will not be permitted on the Club Premises, any person found in contravention to this will be immediately expelled and the police informed.
10. Regular testing of the Fire alarm, smoke alarm and Emergency Lighting is in operation.
11. All relevant escape route signs have been fitted and will be maintained.
12. Emergency lighting will be located at all escape routes.
13. Gangways, exit routes and steps must be maintained in good order.
14. The emergency lighting with which the premises are provided shall be maintained in efficient working order and be in operation during the whole time that the public are in the premises.
15. The existing system must illuminate all exit signs, doorways, step and passages forming exit routes from the licensed premises and including the gardens and car park and shall be independent of the normal lighting system. Oil lamps and candles shall not be used.
16. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
(The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
17. The gas system, including the boiler will be inspected by a CORGI registered engineer annually and a satisfactory Gas certificate will be obtained.
18. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
19. Free drinking water shall be available at all times.
20. A First Aid box shall available at all times.
21. All staff shall be given suitable training as what to do in the event of an emergency and in general safety precautions.
22. Regular glass and bottle collection shall be undertaken throughout opening hours.
23. All bottles and kegs shall be removed from the public area and stored securely.
24. Double glazing has been fitted throughout the main Club building to prevent noise escapement. This shall be maintained.
25. Adequate extraction ventilation shall be provided throughout the buildings in order that when music is being played, windows can be kept closed to prevent noise nuisance to the surrounding neighbours.
26. When regulated entertainment is taking place in the club premises all windows shall be kept shunt and staff must regularly check that the windows are kept closed.
27. The heavily lined full length curtains which have been fitted at the end of the family room to further keep noise escapement to a minimum shall not be removed unless replaced.
28. A notice shall be displayed at the exit to request the co-operation, of patrons in particular, to be as quiet as possible when leaving the premises.
29. Patrons must be asked not to stand around talking in the street outside the premises when leaving.
30. All performers using amplified music shall be asked by management to reduce the output as to be not distinguishable above background levels and shall not cause a statutory nuisance.
31. A member of staff must assess the impact of any noisy activities on neighbouring residential premises at the start of the activity/entertainment and periodically throughout the activity/entertainment to ensure that noise levels are within background levels.
32. The emergency exits shall be maintained as well fitting and kept shut during opening times.
33. The club shall nominate a specific taxi operator and in the future will maintain a nominated taxi operator. The company’s telephone number must be kept readily available for customers. The nominated taxi operator, and all taxi drivers calling to collect passengers at the club must be instructed that they should arrive and depart as quickly as possible, should not sound vehicles’ horn as a signal of their arrival or leave engines running unnecessarily.
34. The club must ensure that all staff will leave quietly
35. The delivery of goods shall be restricted to the normal working day.
36. The handling of beer kegs and bottles must not take place in the late evening to prevent excess noise to the surrounding residents.
37. The movement of bins and rubbish outside the building must be restricted to daytime operation only.
38. All collectable bottles shall be stored in designated wheelie bins.
39. No child under the age of 16years of age shall be admitted to the Club premises unless accompanied by an adult member. Notices to that effect shall be posted on the Club premises.
40. No child under 16 years of age shall be allowed in the Members Bar, where a gaming machine is located unless they require access to the toilet facilities and in any case they must be accompanied by an adult. A notice to this effect shall be displayed in the club to inform/remind members.
41. A proof of age policy agreed by the police and local authority must be in force.
42. The designated "family room" is and shall be promoted as to the venue for members with accompanying children.
43. An adequate supply of soft drinks and chocolate must be readily available for the consumption on the premises.
44. Regular checks/inspections shall be carried out by staff and management to ensure that all accompanying children are behaving correctly.
45. Suitable door staff registered with the Security Industry Authority shall be employed from 8.00 pm (or from the commencement of the event which ever is the later) until 30 minutes after the end of permitted hours on any day that live and recorded music is planned to takes place on the premises with the event being open to the public and continuing after 12 midnight.
46. All doorstaff will:
(a) Be correctly registered with the SIA
(b) Display the correct name badge
(c) Carry proof of registration
(d) Be used at a ratio to be agreed by the Police and Local Authority, which is currently 1:75
(e) A female supervisor will be available if searches are to be conducted on female customers
(f) Will wear clothing that can be easily and clearly identifiable on CCTV - i.e. wear a reflective number between 1 and 99 (at least 100mm high) in a prominent position on the upper part of the body
(g) Will be in attendance at the entrance of the premises from 8.00 pm (or from the commencement of the event which ever is the later) until the main exit doors to the premises are closed, and any time when patrons may be queuing for access
47. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority.
48. Recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Local Authority).
49. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
50. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
51. The supply of alcohol and the licensable activities will be confined to the area(s) marked on the attached plan deposited with and approved by the Licensing Authority for the ‘Consumption of Alcohol’ and Licensable Activities’
