ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to supply alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in the club premises where they are residing.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the club premises.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the club premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
Conditions Consistent with the Operating Schedule
1. The premises will liaise with the District Council and Police authorities as necessary to further the licensing objectives.
2. With the exception of wine (to be served in a wine glass) alcohol and soft drinks will be served in plastic or toughened glass.
3. All bottles to be served to the customers will be made of plastic.
4. No customer carrying open vessels containing alcohol will be admitted to the premises at any time.
5. No customers will be permitted to take open vessels containing alcohol from the premises.
6. All bottles and glasses will be removed from the members areas on a regular and frequent basis.
7. The Axminster Conservative Club has a zero intolerance to illegal drugs and its use or supply on the premises will result in:-
a) Report to the Police.
b) Termination of membership and banning from the club.
8. A ‘customer code of conduct’ poster will be prominently displayed warning customers that if they act in an inappropriate manner they could be barred from all licensed premises in the vicinity.
9. All exit doors will be easily operable without the use of a key card, code or similar means and will be available for egress while the public are on the premises.
10. Means of escape will be maintained unobstructed immediately available and clearly identifiable.
11. Exit doors will be regularly checked to ensure they function satisfactorily. Records of these checks will be kept and produced on request.
12. All fire doors will be maintained effectively self-closing and shall not be held open other than by approved devices.
13. All gangway, exit ways, treads of steps or stairways will be maintained with non-slippery and even surfaces.
14. All floor coverings will be secured and maintained so they will not ruck. Mats will be fitted into a mat well so as to be flush with the floor surface.
15. Hangings, curtains and temporary decoration will be maintained in a flame retardant condition.
16. Upholstered seating will be fire retardant and compliant with current Fire Safety Regulations.
17. Fire drill and emergency lighting tests will be conducted monthly.
18. Records of these tests will be made available to the Licensing Authority upon request.
19. All fire exits and means of escape will be signed in accordance with BS5499.
20. Wall and ceiling finishes will be fire resistant.
21. Exit doors will open outwards (or will be secured in the open position).
22. When disabled people are present adequate arrangements will exist to enable their safe evacuation in the event of an emergency.
23. Adequate and appropriate supply of first aid equipment and materials will be available on the premises.
24. The club steward shall check the first aid equipment and materials at least once a month.
25. In the absence of adequate daylight the lighting in any area accessible to the public will be fully operational.
26. Fire safety signs will be adequately illuminated.
27. Emergency lighting will not be altered.
28. Emergency lighting batteries will be fully charged before the admission of the public.
29. Emergency lighting tests will be conducted monthly.
30. Records of these tests will be made available to the Licensing Authority upon request.
31. All lavatories, urinals and wash basins shall at all times be kept in good order and repair and be properly and effectually cleaned, ventilated and disinfected and supplied with water and all necessary requisites and all doors leading thereto shall be suitably marked.
32. The electrical system at the premises, including portable appliances will be inspected and tested annually by a competent person to ensure safety.
(The installation will have a full inspection at least every 3 years and be tested annually. A competent person will be a qualified electrician who is qualified to complete works as per the I.E.E. wiring Regulations 16th Edition or is registered with the ECA or NICEIC.)
33. Where temporary electrical equipment is used, a suitable circuit breaker device will be installed to cover this equipment. The circuit breaker will operate at a current not exceeding 30 mA and must comply with BS 4293. The device will be tested monthly and the tests will be recorded in a log kept for the purpose.
34. Temporary electrical wiring and distribution systems will not be installed unless inspected by a suitably qualified electrician. Temporary electrical wiring and distribution systems will comply with BS 7671 or, where applicable BS 7909.
35. Temporary electrical wiring and distribution systems, not installed by a suitably qualified electrician, will be inspected and certified by a qualified electrician before they are put to use.
36. The Gas System, including appliances, will be inspected and tested by a Gas Safe registered engineer annually and a satisfactory Gas Safety Certificate will be obtained.
37. Any oil fired boilers and appliances currently installed on the premises or installed in the future will be inspected and tested annually and an OFTEC certificate of inspection will be obtained.
38. All safety certificates and inspection reports will be kept on site and made available for inspection by officers of relevant statutory bodies.
39. The premises will have a satisfactory NICEIC or EC periodic emergency lighting report.
40. An inspection is carried out every year and a new report obtained each time.
41. The premises have suitable public liability insurance in the sum of not less than £2,000,000 (Two Million Pounds).
42. A certificate is obtained and each time displayed at the premises.
43. The premises will have a Certificate of Inspection for Portable Fire Fighting Equipment.
44. An inspection will be carried out regularly and a new certificate obtained each time.
45. A list of local taxi firms and their telephone numbers will be prominently displayed.
46. Drinking up time is 20 minutes after last alcohol is served or 30 minutes if a meal has been taken to prevent congestion on departure.
47. Prominent clear and legible notices will be displayed at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.
48. A crime prevention policy agreed by the Police and Licensing Authority will be in place if required.
49 The premises will adopt a Challenge 25 policy. The only acceptable forms of ID will be Passport, Photo Driving Licence or Government Approved PASS Card.
50. An incident book must be maintained within which full details of all occurrences of anti-social behaviour, disorder and refused alcohol sales at the premises must be recorded.
51. The incident book must be kept on the premises at all times and must be made available for inspection by officers of both the Licensing Authority and the police.
52 The Club Steward will provide day-to-day control of the premises, providing good training to staff on the Licensing Act and to make sure there is no under-age drinking, anti-social behaviour or use of illegal drugs on the premises.
53. A notice will be placed outside the premises indicating the normal opening hours. Only members and their bona fide guests to be admitted to the premises.
54. Alcohol will not be served to anyone who appears intoxicated or be allowed to consume alcohol on the premises, they will be asked to leave the premises in such situations.
55. All staff will be vigilant in illegal drug use on the premises and anyone found using illegal substances will be asked to leave the premises.
56. All cases of anti-social behaviour to be recorded and referred to the Club Committee to consider whether further action is required including a review of their continued membership of the Club.
57. The Axminster Conservative Club will be a member of the local Licensees Association to ensure that anti-social behaviour is not tolerated within Axminster.
58. The Management Committee to undertake regular risk assessment reviews.
59. The Management Committee will ensure that regular checks are made by the Club Steward on the following, with details of the checks recorded:
1. Escape routes are kept clear and fire escape doors are fully operational.
2. Emergency lighting is fully operational.
3. All lighting on the premises is fully operational.
4. All fittings, electrical goods, fire extinguishers, door fastenings and notices, heating, air conditioning, sanitary accommodation and other installations are maintained always in good order and in a safe condition, with safety checks carried out by qualified person where appropriate.
5. First aid box is fully stocked.
60. A prominent notice will be displayed at the exit requesting members and their guest respect the needs of nearby residents and to leave the premises and the area quietly at closing time.
61. Customers will not be admitted to premises outside of normal opening hours except in exceptional circumstances.
62. The movement of bins and rubbish outside the premises will be kept to a minimum after 11.00pm.
63. Adequate waste receptacles for use by customers will be provided for smokers outside
64. Persons under the age of 18 will not be allowed Club membership. Any persons believed to be under the age of 18 will be asked to provide acceptable ID (a card bearing the PASS hologram, a photographic driving license or a passport) if they wish to buy alcohol, following the guidelines of Challenge 25. This would also apply to bona fide quests of members.
65. No person under the age of 18 will be allowed on the premises unless accompanied by a Club member or an associate member.
