ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. Alcohol shall not be sold or supplied:
(i) Unless the premises have been structurally and bona fide used, or intended to be used, for the purposes of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises; and unless the premises are bona fide used, or intended to be used, for the purposes of habitually providing for reward board and lodging, including breakfast and one other at least of the customary main meals;
(ii) On the premises otherwise than to persons taking table meals there and for consumption by such a person as an ancillary to their meal, or to persons residing there or there private friends bona fide entertained by them at their expense, and for consumption by such a person or their private friends so entertained by them either on the premises or with a meal supplied at but to be consumed off the premises.
2. The times permitted to sell alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in any premises, where the premises are bona fide used, or intended to be used, for the purpose of habitually providing for reward, board and lodging, including breakfast and at least one customary main meal.
3. Suitable beverages other than intoxicating liquor (including drinking water) shall be equally available for consumption with or otherwise as an ancillary to meals served in the licensed premises.
4. There shall be afforded in the premises, for persons provided with a board and lodging for reward, adequate sitting accommodation in a room not used or to be used for sleeping accommodation, for the service of substantial refreshment or for the supply or consumption of intoxicating liquor.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first thirty minutes after the permitted hours the consumption of alcohol on the premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
Conditions Consistent with the Operating Schedule
1. The premises will liaise with the District Council and Police authorities as necessary to further the licensing objectives.
2. CCTV will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and the Licensing Authority.
3. CCTV recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Licensing Authority).
4. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
5. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
6. The premises will have a zero tolerance policy on the use or supply of illegal drugs.
7. Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
8. In absence of daylight all lighting accessible to public will be operational including emergency lighting.
9. The premises have public liability insurance renewed annually and the certificate displayed each year.
10. Floor coverings maintained so they do not ruck.
11. Stair treads, exit gangways maintained.
12. All exit doors open outwards and easy to operate.
13. All means of escape will be unobstructed and clearly identifiable.
14. Fire drills and emergency lighting will be tested regularly.
15. All staff trained in evacuation procedure.
16. Fire brigade will be called out to any outbreak however slight.
17. Warning notices ‘In the event of fire’ will be prominently displayed.
18. CCTV will cover the car park.
19. Guests leaving later (after midnight) will be requested to leave the premises quietly.
20. The car park lights switch off at 12:30 am.
21. The building shall be double glazed.
22. No unaccompanied children shall be served.
23. The licensable activities authorised by this licence will be confined to the areas that are shaded in PINK on the plan deposited with and approved by the Licensing Authority. The area outlined in BLUE on the plan relates to the restaurant area and the corresponding embedded restaurant conditions.
