ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The sale of alcohol of all descriptions is authorised by this Licence.
2. Alcohol shall not be sold in an open container or be consumed in the licensed premises.
Conditions Consistent with the Operating Schedule
1. CCTV must be installed, operated and maintained to the reasonable satisfaction of the Licensing Authority and the Chief Officer of Police in accordance with the requirements set out in the current EDDC Licensing Policy.
2. The CCTV system must be operational at all times whilst the premises are trading. If the system is faulty or not working then the Police and East Devon Licensing Service must be informed via email within 24 hours of discovery. Details of the malfunction must be recorded in the premises incident book.
3. CCTV images must be retained for a minimum of 14 days and to be produced on the request of the Police or a Licensing Officer of East Devon District Council. Recording media must be set to 25 frames per second.
4. A4 sized warning notices must be displayed in public areas of the premises and at all entrances advising that CCTV is in operation. The signs located at entrances should be located on the exterior of the building at, and adjacent to, all public access doors. All signs must comply with the requirements of the Data Protection Act 2002.
5. The premises will have a challenge 25 policy operating at the Premises. Challenge 25 means that the holder of the premises Licence shall ensure that every individual, who visually appears to be under 25 years old and unknown to the staff member serving as a person over 18 years old, and is seeking to purchase alcohol from the premises, shall produce Identification proving that person is over 18 years old.
6. Acceptable identification for the purposes of age verification will include a photo driving licence, passport or photographic identification bearing the “pass” logo and the persons date of birth. If the person seeking alcohol is unable to produce acceptable means of identification, no sale of alcohol will be made to that person.
7. Challenge 25 posters shall be displayed in prominent positions at the premises.
8. Spirits will be displayed behind the counter and will not be self service.
9. A written log shall be kept of all refusals and will include refusals to sell alcohol. The refusal log will be kept and maintained at the premises and will be available for inspection immediately upon request by the police and any responsible authority. The record of refusals log will be retained for 12 months.
10. Staff will be trained with regard to the sale of alcohol. Records will be kept of such training which must be signed and dated by the member of staff who has received that training. An appropriate alcohol sales training manual to be utilised.
11. All staff will receive refresher training annually as a minimum and records are to be kept of this refresher training which should be signed and dated by the member of staff who received that training.
12. All training records will be made available for inspection upon reasonable request to the police or any responsible authority.
13. Notices to be displayed prominently requesting customers to leave the site quietly respecting local residents.
14. Forecourt litter bins will be emptied regularly and the forecourt swept regularly.
