ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to sell alcohol on this licence do not prohibit or restrict on the licensed premises the sale or supply to, or consumption of alcohol by, any person residing on the premises.
2. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale of alcohol to a trader or club for the purposes of the trade or club.
3. The permitted hours to sell alcohol on this licence do not prohibit or restrict the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered.
4. The permitted hours to sell alcohol on this licence do not prohibit or restrict the taking of alcohol from the premises by a person residing there.
5. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by them at their own expense, or the consumption of persons so supplied.
6. The permitted hours to sell alcohol on this licence do not prohibit or restrict the supply of alcohol for consumption on premises to persons employed there for the purposes of the businesses carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
7. The permitted hours to sell alcohol on this licence do not prohibit or restrict the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces.
8. No licence is required for the provision in the premises of public entertainment by the reproduction of wireless (including television) broadcasts or programmes included in any programme service (within the meaning of the Broadcasting Act 1990) other than a sound or television broadcast service or of public entertainment by way of music and singing only which is provided solely by the reproduction of recorded sound.
9. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the permitted hours, the taking of alcohol supplied in the premises from the premises unless the alcohol is supplied or taken in an open vessel.
10. The permitted hours to sell alcohol on this licence do not prohibit or restrict, during the first twenty minutes after the end of permitted hours the consumption of alcohol on the premises.
The Following Additional Condition Applies
1. Children under the age of 16 will not be permitted to remain on the premises after 9.00pm.
Conditions Consistent with the Premises Operating Schedule
1. The management will ensure that all staff members are trained on the requirements of the Licensing Act 2003 upon recruitment.
2. The management will ensure that all staff members are given appropriate training on the awareness of drug misuse.
3. The provision of a 30 minute extension of opening hours after the end of the sale of alcohol will provide a cooling down period allowing the last drink to be consumed less hurriedly. Access to the premises toilet facilities will be maintained during this period.
4. A personal licence holder will be present on the premises at all times when the premises are trading.
5. There will be no provisions for happy hours.
6. The management and staff will take all measures to prevent binge drinking on the premises.
7. The premises will be a member of Pubwatch and a representation will attend Pubwatch meetings and participate in all initiatives including notifying other local public houses of potential trouble.
8. Staff will be trained in crime prevention measures.
9. Fire safety and other safety measures which requires the premises to be maintained in good order, and the adequacy of these measures, will be determined on a regular basis by carrying out a risk assessment as required and in accordance with the Fire Precautions (Work Place) Regulations and/or any other legal requirement which may be in force from time to time.
10. We recognise that the safety of occupants is also influenced by the numbers of persons present, their disposition and the activities taking place and we will give consideration to capacity limits proposed by the Police, Fire Authority or Local Authority and in any case the number of persons present on the premises will never exceed 200, including staff and performers.
11. Irresponsible drinks promotions will not be permitted, and the Standards for the Management of Standard Drinks Promotions produced by the British Beer and Pub Association will be complied with.
12. No smoking will be permitted in the restaurant area, and 50% of the bar is designated as no smoking. Smoking will not be permitted in front of the main bar.
13. All live and recorded music in the garden will stop at 9.00pm.
14. The levels of background music will be kept low.
15. All windows at the premises will be shut at 12midnight.
16. The children’s play area will closed and locked at dusk.
17. Patrons will be requested to respect the needs of local residents and to leave the premises and the area quietly.
18. The kitchen extractors and filters will be cleaned on a weekly basis to minimise the impact of cooking smells.
19. A photographic proof of age policy agreed by the police and local authority will be enforced.
20. Glassware, cutlery and crockery will not be allowed to be taken into the children’s play area.
21. No children will be allowed into the bar area of the premises after 9.00pm.
22. Children will not be allowed in the area of the bar where smoking is permitted.
23. The licensable activities authorised on this licence will be confined to the area(s) outlined in RED on the plan deposited with and approved by the Licensing Authority.
