ANNEXE 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Embedded Conditions Consistent with the Licensing Act 1964
1. The permitted hours to supply alcohol do not prohibit or restrict the supply to, or consumption by, any person of alcohol in the club premises where they are residing.
Conditions Consistent with the Operating Schedule
1. The Licensee will have regular liaison with the Licensing and Responsible Authorities.
2. An electronic lock will be fitted and maintained to the clubs outer door.
3. If after the expiry of six months from the second appointed date the Licensing Authority serves written notice on the licensee requiring that CCTV be provided it will be installed, maintained and operated to the satisfaction of the Chief Officer of Police and Local Authority and conditions 4 to 6 also complied with.
4. CCTV recordings will be maintained for an appropriate period of time (generally one month - but to be agreed with Police and Licensing Authority).
5. If the CCTV equipment is inoperative, the Police and Local Authority will be informed as soon as possible and immediate steps will be taken to put the equipment back into action.
6. A notice will be displayed at the entrance to the premises advising that CCTV is in operation.
7. Save for wine, alcohol and soft drinks will be served in plastic or toughened glasses.
8. All bottles to be served to the customers will be made of plastic.
9. No customer carrying open or sealed bottles or glasses will be admitted the premises at any time.
10. All bottles and glasses will be removed from public areas and the grounds on a regular and frequent basis.
11. A proof of age policy to the satisfaction of the Police and Licensing Authority will be in place.
12. The Club has a zero tolerance to illegal drugs and use or supply on the premises will result in: report to the police, termination of membership and banning from the club.
13. A detailed “customer code of conduct” poster will be displayed warning customers that if they act in an inappropriate manner they could be barred from all licensed premises in the vicinity.
14. An incident book will be kept detailing any instances of Public Disorder or matters affecting the licence e.g. attempt to buy alcohol underage.
15. All exit doors will be easily operable without the use of a key card code or similar means and will be available for egress while the public are on the premises.
16. Means of escape will be maintained unobstructed immediately available and clearly identifiable.
17. Exit doors will be regularly checked to ensure they function satisfactorily. Records of these checks will be kept and produced on request.
18. All fire doors will be maintained effectively self-closing and shall not be held open other than by approved devices.
19. All gangways, exit ways, treads of steps or stairways will be maintained with non-slippery and even surface.
20. All floor coverings will be secured and maintained so they will not ruck. Mats will be fitted into a mat well so as to be flush with the floor surface.
21. Hangings and curtains will be secured and maintained in a flame retardant condition.
22. Upholstered seating will be fire retardant and compliant with current Fire Safety Regulations.
23. Access will be provided for emergency vehicles and this access will be kept clear and free from obstruction.
24. Fire Drill and emergency lighting tests will be conducted monthly. Records of these tests will be made available to the Licensing authority upon request.
25. All fire exits and means of escape will be signed in accordance with BS5499.
26. Wall and ceiling finishes will be fire resistant.
27. Exit doors will open outwards
28. When disabled people are present adequate equipment arrangements will exist to enable their safe evacuation in the event of an emergency
29. Adequate and appropriate supply of First aid equipment and materials will be available on the premises. There shall be a nominated First Aider.
30. The First Aider shall check the First Aid equipment and materials at least once a month.
31. In the absence of adequate daylight the lighting in any area accessible to the public will be fully operational.
32. Fire Safety signs will be adequately illuminated.
33. Emergency lighting will not be altered without the prior written approval of the Licensing Authority and the Devon Fire & Rescue Service.
34. Emergency lighting batteries will be fully charged before the admission of the public.
35. Emergency lighting tests will be conducted monthly
36. Records of these tests will be made available to the Licensing Authority upon request.
37. All lavatories, urinals and wash basins shall at all times be kept in good order and repair and be properly and effectually cleaned, ventilated and supplied with water and all necessary requisites and all doors leading thereto shall be suitably marked.
38. The premises have a satisfactory NICEIC or ECA periodical electrical installation report. An inspection is carried out every year and a new report obtained each time.
39. The premises have a satisfactory NICEIC or ECA periodic emergency lighting report. An inspection is carried out every year and a new report obtained each time.
40. The premises have a CORGI Certificate of inspection in respect of any gas boiler or calorifiers or appliance. An inspection is carried out every year and a new report obtained each time.
41. The premises have a suitable Public Liability insurance in the sum of not less than £2,000,000.00 (two million pounds). A certificate is obtained each time.
42 A variation of the club premises certificate will be sought for any alteration of the premises which would make it impossible to comply with the Operating schedule.
43. Free drinking water will be made available at all times.
44. A list of local taxi firms and their telephone numbers will be prominently displayed.
45. Prominent clear and legible notices will be displayed at all exits requesting patrons to respect the needs of local residents and to leave the premises and the area quietly.
46. A crime prevention policy agreed by the Police and Licensing Authority will be in place.
47. The club has a Child protection policy in place.
48. A variation of the club premises certificate will be sought for any alteration of the premises which would make it impossible to comply with the Operating schedule.
49. The extent of the areas within which the various licensable activities will be permitted are indicated as follows on the plan deposited with and approved by the Licensing Authority: Regulated Entertainment and Entertainment Facilities will be permitted within the areas shaded PINK and the Sale of Alcohol will be confined to the area shaded PINK together with the Bar Servery shaded GREEN.
